Ebay advice please

Been a long time lurker on the boards and just wanted some advice. I won a pair of tracksuit bottoms descibed as very good condition. When opened looked at them and they were stained and had gloss marks down them. Politely asked for a refund, seller emailed back saying that it was her fault that she disn't check the item…
