    Sorry, but you CAN NOT be refused a job for refusing to give up your right to work more than 48 hours. In fact my husband CAN get his right to the 48 hiuor week back, he just has to give 3 months notice- time for them to sort out a new shift pattern for him. You cannot be forced to opt out of the 48 hour week!

    No but it is unwise to go against the grain because you just put a target on your back.
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

  • And he got NO disciplinary action only been removed from the site!! So thats BRILLIANT. Means if he has any small slip ups which he had betetr not if he wants to keep his man veg.....then he wont get fired due to having a warnign already!

    He has now been given a permanent site, better hours (only days!!!!!! yey!!) and 30p more an hour!!!!!!!!!!!!!!!! :D His boss was taking the mick in the office today whenj we went in to take something to him, saying you fall asleep on the job and come out of it with a better job with better hours for you and a payrise!! lol, we're not complaining thats for sure!!!!

    That is a proper result all round!

  • About the fact he didnt let his boss know he was overtired, if you knew his boss you would know why.

    He cannot take days off sick without having his boss have a go at him about it, saying he is leaving them in the lurch (even if he gives 10 hours notice he is told he is leaving them in the lurch!) and they try to persuade him to come in.

    He had a car crash in March 08, the car was a write off- he was on his way to work at the time. He banged his head quite hard in the crash, and phoend his boss to tell him he had crashed his car and he would be unable to get to work- his boss not once asked about his welfare, but said "go home, have a coffee and the supervisor will pick you up in 2 hours". He is terrified of asking for the night off, as whenever he does he is treated like cr*p, and was once given a disciplinary (over 12 months ago) for taking a day off sick because he didnt give the allocated 6 hours notice...he gets in from work at 8am, goes to sleep and wakes at 2ish ready for his shift at 5...he doesnt have time to give 6 horus notice if he gets sick before work, which he stated, but he still got a written warning for it!!!!! Hence why he didnt tell his employer he was tired, yes it was terrible of him, and I am not making excuses at all. But just telling it how it is, so you can get an idea why it happened how it did :)


    I don't know much about employment law but just wanted to let you know that even if other people are snarky about your post, I can imagine what a boss like that would be like and feel really sorry for your husband! What a horrible man!

    If he has declared his medication then hopefully the company will think twice about firing him, as they cannot just pretend they knew nothing about it. It sounds like a pretty s***ty job to have and it sucks that jobs are so hard to come by that most people don't have the luxury of choice. I hope everything works out for your husband and he will keep his job!

    If he has declared his medication then hopefully the company will think twice about firing him, as they cannot just pretend they knew nothing about it.     I actually think the company have acted fairly reasonabally here - they held an investigation where they could have sacked the OP husband - but he stated mitigating circumstances (medication), they have decided to find him a more suitable job - a daay job infact.

    Of course the biggest issue is the time it took them to sort it ....

    Actually they sorted it out very quickly! Things like this can drag on for months.
    Lost my soulmate so life is empty.
