Mother over 75's TV licence - can we use the TV?

For those that are interested many thanks, I'll keep going. I have contacted the TV licensing people by email at the FAQ section on the website. I don't think they understand the question and have said no to this.
Mum lives by herself in her own house and is over 75 with a licence expiring October 2011. She died last week at the age of 87. I (son) need to find a day a week/fortnight to pop over to the house check security , do a bit of tidying ready to sell it next spring/summer. Whilst I'm there can I use the telly!?
Point 3 on this link under the NB suggests fine. The thickos answering my emails say no.

We’ll cancel the over 75 TV Licence. There’s no refund on an over 75 TV Licence, as it’s issued free of charge.
So that supports the argument that you would not be covered. When my MIL passed away last year the TV licence ceased to be valid immediately and had to be returned.0

Glad I read this thread - I do live with a 75+ person and had assumed I would have to buy a new licence as soon as she died, so that's one less thing to worry about!
