Driving Test FAIL - Appealing the result - Anyone tried/succeeded ?

    You have lost the plot completely.
    Your nephew has failed his driving test, he will not be the first or the last person to achieve this.
    You are obviously under the impression that he can do no wrong.
    If he takes his next test in a car not fitted with dual controls, then I hope that he puts in a flawless performance.
    You cannot demand a different examiner.

    Pheasants are crazy. They will walk into the road right in front of you, leaving you no time to brake. If a pheasant walked out so far ahead that the examiner had time to brake then the driver should have been able to.

    In the early 80s I got failed for incorrect use of gears on a motorcycle on an automatic bike! Fair enough they were exceedingly rare (and bloody dangerous to be honest). I got a free retest the same day (someone’s cancellation or no show) and passed after I complained. I think that is a particularly rare example though.

    Indeed they are, I bet nobody has ever seen a crow walk out in to the road, far more sensible birds.;)
  • LandyAndy is correct - your nephew failed to respond as required to the hazard that was in the road ahead of him, so the examiner had to intervene and take evasive action. Maybe your newphew needs further practice on hazard perception???

    Obviously there's only the OP's side here, but from what I've read it reads very strongly that the nephew didn't react, where the examiner did.

    Appealing it would be interesting to say the least- the examiner would argue that had he not applied the brakes, the car would have hit the pheasant. Ever seen the remains of a pheasant and the damage it could do to a car? Landy's right- they are crazy, they step out and can even stand looking at an oncoming car, totally non-plussed.

    The best bit is when they realise that you might be a danger and run full tilt down the road in front of you. :rotfl: Flying doesn't seem to occur to them.

    They are gorgeous birds, but more than a little lacking in grey matter. And they seem to have an amazing ability to turn into a concrete bollard if you're unlucky enough to hit them...
  • If the examiner feels the need to use the brakes, or take any other action while you are driving, then it's an instant fail. At this point not even the examiner himself could award you a pass!
  • if im honest would i carry out an emergency stop on a country road for a pheasant? When ive got kids in the back? no, id come off the gas and if the road were clear nudge to right a bit , but i reckon its more dangerous to slam the brakes on.

    yeah sure when youre on your test things are different. but in reality thats !!!!!!!!. anyways road kill tastes nice. peace
