My father claims IS due to his heart condition and problems with asthma. He had to urgently go abroad (2 weeks ago?) to care for his parents and they seem to have cut all pay to his name. (which my mother was using around the home.) If I'm not mistaken, the rent gets paid separately but is also under my fathers name, so I'm assuming its been cut off. (there's no way to verify this atm.)

Are you sure that it's IS he's claiming rather than IB?

How old is your father? Does he still meet the conditions for Income Support?:

How long is he going to be out of the country?

You forgot to include the second list of conditions which needs to be complied with alongside those you listed.

    "a lone parent
    on parental or paternity leave
    a carer
a refugee learning English who arrived less than a year ago"

How old are the children living at home?

If the youngest is 7 then your father is expected to move onto JSA...

Was it maybe income support to top up incapacity?

OP if you could get more info on why your father is on income support and any other benefits he or your mum are on that would be most helpful. Are your younger brothers living at home or are they there temporarily?

If your father is too ill to work and claiming benefits on this ground he may have had them stopped if he is able to leave the country to care for someone else. Just a thought but I'd need more details.

These are conditions which may allow you to claim IS but they aren't in the initial list of what a person needs in order to qualify for IS.
Who can get Income Support - from direct.gov.uk

It's for people who all the following apply to:
    • are between age 16 and the age they can get Pension Credit
    • have a low income
    • work less than 16 hours a week
    • aren't in full-time study (but there are some exceptions)
    • don't get Jobseeker's Allowance or Employment and Support Allowance
    • don't have savings above £16,000
    • live in Great Britain
You may get Income Support if you are one of the following:
    • a lone parent
    • on parental or paternity leave
    • a carer
    • a refugee learning English who arrived less than a year ago
Young people in relevant education may also get Income Support. Generally this means full-time education up to GCE A-level or Scottish Certificate of Education (Higher level). This might apply if you:
    • are a lone parent
    • don't live with a parent or someone acting as a parent
    • are at serious risk of abuse or violence
    • are a refugee learning English

its a guess but he may have an existing claimer of IS on incapacity grounds. He might have had a letter to attend a medical to either stay on IS or go onto ESA and didn't reply or attend so his claim has been stopped.

His wife can make a claim for benefits in her own name. If he was getting HB and CTB linked in to his IS claim, these would have stopped too so she needs to claim these too. Best if she makes an appointment to see CAB or similar to get this sorted.

    Hey,

Well, I went around her house today, and thought I'd give them a call before I went to the JC. Apparently the application was over-the-phone and online only. I sat on the phone for 55 minutes and went through the process and was told she'll have to go in to the local JCP tomorrow at 10:30 for a work-focus interview.

Regarding all the above replies... From what I know, his only receiving I.S. His weekly pay is £154.84 (paid every 2 weeks = £317.68.) so I'm not quite sure what it was he was claiming exsactly. But my mother says that shes sure it was I.S only, and not aware of anything else.

It looks like IS plus some sort of premium. However, I can't quite work out which one. (Basic IS for a couple is £102.75 per week)

Is there a reason why she cannot sort this out herself?
    Gone ... or have I?

I am pretty sure that his IS has been stopped because somehow or other the JC has been told/informed he is out of the country. Your mum needs to make a claim, (make a new claim) asap because it will take time to get any money, and she'll automatically have the first three days taken off it.

Yup, made the claim today, going to go to the interview tommorow.
    With your father incommunicado...

Ooow... Posh word... I had to look it up ;)
she'll have to say he's left her, which in a way (being incommunicado) he has. She can't manage with no income, as i would assume they don't have enough coming in to make it easy to pay back Crisis Loans/housing benefit arrears. The less of a payment gap there is, the better.

I was suggested to say to the JC that he left her and went away with no contact but to be honest... That sounds a little to much. It's true she can't manage without any income.

Regarding the housing benefit... I thought the two where separate from one another? Would she also need to claim H.B? The actual letters come in her name (oddly enough) but the H.B is paid into my fathers name, if that's of any help.
