    I am so sorry regarding the problems you are having. A long time ago I bought a 2CV for nigh on £1300 (a lot in those days). When it came to its MOT 9 months later it failed, because the chassis was knackered and would cost £900 to replace ( a common fault in a 2CV). Anyway, to cut a long story short, I took this bloke to the small claims court and I got most of my money back ( I tried having it repaired - stupid me!), so lost some. Also, try the CAB (Citizens Advice Bureau), or your local Council Advice Service, for help. Anyway, in my case I had access to a Mechanical Engineer ( I think that is the name for somebody who specialises in cars/vehicles) and asked his advice, he came to court and I got the majority of my money back. Good luck!!

    You had an engineer who probably said the car was not fit for purpose or unroadworthy at the time of sale, due to the severity of the corrosion. Just so the OP knows you were not rejecting the car you were relying on section 14 of SOGA. There may have been a deduction for the use you got out of the vehicle for 9 months.
  • thanks, but the problem these days is everything has changed so much there is no thought, no help, no compassion, no love. Its dog eat dog out there even for pennies. Sad times. If your over 45 your considered stupid by the younger generation. No respect. But I was happy to hear you got your money back after all that time. So there is hope for my predicament.

    My parents had almost exactly the same situation years ago, except they only paid £350 for it. Then the same again or something on a galvanised chassis. Never pursued it though. Dealers must have known they all had carp chassis.
  • hi i sent that letter saturday, the garage has just called me, in the letter i stated that i wanted a full refund and I rejected the car, i told then to call me back after 2 as im working. feeling quite anxious as Im worried they are still going to try to palm the corsa onto me. any advice out there thanks

    Just stick to your guns and get anything significant in writing if possible. :)
  • they called me saying that no refund and to come and collect the corsa or they will start charging me storage, and that they were going to call the police and say I had stolen the courtesy car they gave me. this is all so crazy, I just want my money back, im gonna stick to my guns and go the legal way. they are trying to bully & threaten me.

    You are in for a fight. If you are rejecting the corsa you HAVE to return the loan car. or at the very least tell them it is waiting for them to collect.

    Are they saying the Corsa is now fixed? Has it now got a different engine in it?

    As far as I know when you reject you hand back the Corsa and the usual comeback is that they will charge you for storage. Ultimately this is for the court to decide. If the rejection is allowed there will be no storage costs to pay. If the rejection is not allowed they will have counter claimed for storage costs, it will be for the judge to decide if you have to pay.

    Small claims courts will try to be on the consumers side, i.e. there is a bias in your favour, but there has to be something for the judge to agree with you on. In your case you have some valid points, your only downfall was waiting 3 weeks to put it in writing, but then again you did verbally request a refund on day one.

    We are not lawyers, and we have very little experience in this. You either have faith in yourself and your belief that you are owed a refund and you stick to your chosen path that of rejection (which is the more risky path as you are quickly finding out) or you accept the corsa back and hold them to account in the other part of SOGA which entitles you to a working car or a replacement or a refund which is less risky because there can be no counter claim for storage.

    You might want to ask for some legal opinion on whether you can swap the loan car for the corsa and still carry on with the rejection whilst having the Corsa sit on the road outside your house, with a notice to them to collect it from you. But personally this doesn't sound right to me, but then I'm not a lawyer.

    I didn't see a post from you on UK.legal , that's where I would ask for advice if I were you.
