yes if the seller wants full paypal protection they must show item was posted within 7 days of payment.
OP, you might not be able to actually open an INR claim until a week has passed. Ok after this thread I contacted the seller and he apologised saying he was waiting for the money to clear in his bank and that he would send it Saturday, and that it would reach me by Monday.
I then asked him on Saturday for tracking information and had no response. So today I raised a dispute with paypal.
He contacted me within the hour to say that he tried to send it yesterday but I had held his money. I told him that I only held his money an hour ago and will not stop the paypal dispute until I have the phone in my hand.
He then messaged me back accusing me of threatening him and that he hopes that ****** is my postcode and if not the phone has gone elsewhere.
The postcode was correct but now I am getting nervous as he has provided a tracking number that he might have only sent an empty box or something as he does seem a little malicious.0 -

They can't do that as they've already opened a dispute for "Item not received", and you can't do a second dispute.
The phone needs to be sent special delivery, so hopefully the weight would be enough proof that there was no phone inside! It would potentially be a small claims court procedure though...Should've = Should HAVE (not 'of')

Well as I said he sent me a tracking number but he said as I held his money, he could only afford to send it first class signed for...still waiting. In all these years this is the first real problem I have had with ebay
