thanks every one who gave advice its all been reasuring ,i am going to ask for a copy of the "experts" report and then let it ride , i dont like to think i will have to go to court but as you all seem to say he took to long to complain to start with and i am 100% possative the item was not faulty before despatch my instinct is to see what happens

why he took it apart the printer before he made a claim on you? Where is the evidence then? who is the expert? did he consult you before he instructed a so called expert to take the printer apart? did he know the expert? did the expert get paid for this so called report?
forget him, let him sue you, then deal with it.0 -

dont be intimidated thats what hes banking on.
you dont pay £172 for something and then leave it 3 months before bothering to chase a refund.
ask for the experts report of you want but personally i would just state it was fine when you posted it and if you want to persue it through the courts go ahead because i bet they wont.

So this printer is damaged due to heavy use but according to his expert ,it has never worked!
Maybe he bought yours because he already had one that didn't work ,he would immediately tell you that it didn't when your working model turned up in the hopes of your refunding him in full and his having a free working printer at the end of it all.
Did your printer have any identifying marks at all that he could not just remove?
When he sends the report ,check to see if his expert really is one.
The report should be on company paper and properly worded.
You should be able to contact this expert and ask his opinion on similar machines without actually saying who you are.0 -
no there was no marks as it was in excellent condition and i never got it uv marked , once i have the report your idea of contacting the expert sounds like a plan.0

Mention you have logged serial numbers and put hidden identifing marks on the printer

That could be very useful if your friend is prepared to stand up in court, even though he isn't completely independent.0 -
Unless you are a trader he really has very little come back - as every one says 3 months would be viewed as unreasonable by the courts even if you were a trader and with an expert report.
Please do not pay for the return postage you would not be liable even as a trader and personally i would bluff him out and say you have deanos advised got concelaed security markings!0
