ebay, im being sued

    one of his emails stated he was looking for half the cost of the printer

    "ebay are an impartial body and have no legal intervention on the Consumer Rights as well as The Sale of Goods Act 1979. This is not a threat but I am prepared to take matters further under the legal entitlement mentioned above. All I am asking you is would you be prepared to repay half the cost of the plotter."

  • Well if he has had an expert look at it ask to see a copy of the report from the expert. He is just trying it on. its way to late now to be contacting you moaning about it

    What is he claiming the damage to be?

    It must be something pretty specific if he's saying an expert claims it could not have been caused in transit.

    How did he describe the symptom in the first place?

    Does the damage described fit with the symptom initially reported?

    Only just read that. If its not working why would he want half of the money back. If I brought somthing and it was broken i would want a full refund. Forget about it he is trying it on

    he claimed that the printer was printing staggered lines and not straight ,
    the expert claimed this was due to heavy usage and the carrier rail was badly scored ( scratched )
    and it could never have printed correctly , i can get a copy of this report but the printer has now been taken appart and i dont know the condition its in now
    this is why i feel i shouldnt giv e a refund , or am i just being pig headed

    I don't think you're being pig-headed.

    There's something mighty fishy about the way he's handled this.

    It's also a rather unusual fault.

    I agree with others: he's bluffing.

    If you are sure that the printer was in 1st class working order, call his bluff. As I said above, you're only risking an extra £30 against the cost of the printer and return carriage.

    Get a copy of it first then see who did it and where. I bet you will never see one. he sounds like he is trying it on. How can anyone say that it could never of worked. it could of been danaged on the way to him and if he had asked for a refund within 28 then that fine but who know what has happened to it in three months he could of dropped it

    I dont see why he has waited so long and also why he is only claiming half the money - if it is faulty he would surely want a full refund - something dodgy about him! Whats his feedback like?

    Did you send it by recorded delivery or special delivery? If you did and the buyer's expert says it got damaged in the post could you claim from that? If you send anything RD or SD arn't they supposed to get it there without it being damaged?

    On the other hand I think he's trying it on. He's using bullying tactics and if he was going to take you to court over it he should have done so when he first received it. Who knows what he's done to it since then. I would let him get on with it and see what happens.
