The common law duty of care neighbour principle.
No it wouldn't. Negligence isn't necessary here as the OP's friend bought the item.0 -
That's been done.
@Googlewhacker
Well If the law says she deserves money from this then she does.
It's not normal to pay for a meal and find an inch long bug in it. So someone screwed up. And as a result of someone making a mistake she's ended up spewing.
You and I might not have the same reaction, but then it didn't happened to you or I.
The friend can claim for loss. I don't think, from what you say, any loss has been suffered.0 -

Only her lunch when she chucked it back up
Accept your past without regret, handle your present with confidence and face your future without fear0 -
There is a sickness bug going around. Could that have caused the vomiting?

To be fair, it could have been eaten for a second time thereby providing a benefit.
OP - you owe for a second lunch.0 -
Surely we need confirmation on what kind of insect it was? (unless its been mentioned already and I missed it)
If its a caterpillar or something then its likely just snuck in on something that hasn't been washed properly, if its a cockroach then environmental health need to know I'd have said.0 -
Being totally honest, I'm not sure.
That's why I wanted to find some similar cases, as guidance, should the need arise.
If the manager had dealt with it there and then, and had shown some concern over what had happened, I'm sure that would have been it.
It's taken several calls to the head office to get a reply, and the reply she got was that they will give a reply - at a later date.
I would write to them, explaining what happened and request a refund of your meal. I'd imagine you'll get it back along with maybe a £5 voucher towards another meal, although don't even count on that. I really don't think you can hope for more than that.0 -
How about "get a life"?Happy chappy0

I have a funny feeling the OP is an established member on the wind up.0

The standard of customer service has dropped over the years.
I recall enjoying a night out in an expensive restaurant when I noticed I had a dirty fork, both our waiter and the head waiter could not have been more apologetic, and demanded of the manager that he should fire the entire kitchen staff for their incompetence. That gum you like is coming back in style.0
