Asda sold me out of date products??

    £14,000 per out of date dairy/fridge product sold to be precise!! (i know, worked with them in the past!) really shud have reported it! oh well next time...

    leemina and manchester justin shud have pushed for more of a compensation at the least!

  • gawd almighty.. god forbid people actually take responsibility themselves for checking the stuff they're eating is safe to do so. I understand taking it back and getting an exchange, but acting like its the end of the world and they should be sued smacks a wee bit of american-sue-everyone culture.

    I am sure that many people do take responsibility for what they are eating - after all if the OP hadn't then they wouldn't have spotted the out of date dates. Bear in mind the following though - not everyone has 20/20 vision and can read the small print on some packaging, and out of those with 20/20 vision there are some people (yes even in this country) who cannot read at all and when visiting retail establishments are at the mercy of fate / human error / circumstance. Therefore I would say that in the case of foodstuffs the onus is on the retailer to ensure that "goods sold are fit for purpose". Out of date food is not fit for purpose, retailers have a duty to their consumers and systems in place to prevent this happening. Of course sometimes things do slip through the safety net - but it is the RETAILER who must accept responsibilty for these mishaps, even where malice was not intended, and not the customer.

    What if someone was made extremely poorly by eating something out of date. They have a responsibility to ensure it is safe to eat.

    I dont think it sounds at all like a "sue everyone" culture. The person advising them wouldnt recive the money. It would be a fine for their inability to check their shelves adequately and ensure their products are safe
  • I think the point being made was that no one was hurt in these cases, so as there was no harm done, and ASDA resolved the situation, there's no need to automatically punish anyone for it, even if it is a large company. (not arguing, just adding my two penneth ;) )

    Also, in addition to what firework said, every so often people are in a hurry when doing the shopping, so don't think (or don't have time) to check everything they pick up.

    In any shop, but particularly shops where there isn't a specific CS counter with staff trained to resolve conflicts, my advice (as someone who works for a company where normal sales staff deal with CS stuff like refunds/exchanges etc.) is just to be nice to the member of staff, rather than going in all guns blazing. They (we) are far more likely to be accomodating and generous.

    It's the shop's (not the customer's) responsibility to ensure that the goods they sell are still within the right dates.

    Some of you must be very lucky - the customer services (like the rest of the staff) in my local Asda are rubbish. Out of date goods and overpricing are the norm there.
    But then they're no better in my local Sainsbury or Tesco. I don't seem to have any problem with my local Morrison's (especially if it has a 'Northern' manager) or Waitrose - it really all depends on how good the Store Manager is.

    And when I took a jar of jam which contained a large insect to my local Trading Standards for their comment I was told that I must take the matter up with the store.
  • Hmmm, all the stuff such as dairy and meat products are checked daily to ensure they are not out of date.

    However other foodstuff, such as biscuits etc, are not. If these are out of date they will NOT make you ill in the slightest. For these type prodcts I think at best a customer is entitled to a replacement, and MAYBE a refund.

    You quite forget to check the dates on everything when you are going shopping with 4 kids and i thought the supermarkets were supposed to check their own stock as its illegal to sell out of date stock!!!!!!!!!!!!!!!!

    ALso while im ranting asda are CRAP at checking their dairy produce, on more than one occasion ive had to tell them (before i bought it) that products were out of date!
