  • PS my first offer was for a house which I had fallen in love with an wanted to move to. I did not know of any impending problems so my ambitions may have changed somewhat (£ signs etc.). I am a fatalist and beleive in being in the right (or wrong) place at the r.....

    There is no doubt that the bank loaned 650K on all of this property in 2007,they foreclosed in 2008, the unilateral notices went on after this. Thoughts please.
  • Oh and I forgot, if they do have a claim to the barn side, there is no access to it other than though my drive, there is definitely no right of way been claimed
  • The claimaint to the barn is the person who submitted the planning application and got it in 2006 the time before it was last sold. The bank beleive that they gave a K650 mortgage to the new owner including the cottage, and the barn and all the land in the title deed. The barn claimant is saying it was transfered in error although has no evidence as I know of. If he has he would quickly produce it ...wouldn't he?

    have you downloaded the two neighbours title deeds from the landregistry.gov.uk £4 each....

    the LR does occasionally make mistakes... i was involved with this about 4 years ago, i found when i remortgaged that the propety had never been registered and the title deeds came back with some of my neighbours land on my plot....

    how long have these neighbours lived there.. again you can find this on LR - if it is less than 12 years they cannot claim adverse possession (ie possession through constant usage)

    Yes, have all relevent paperwork I can get. The neighbours claiming half and acre have put a fence up since the cottage has become empty.but it does not show on their title deeds only mine as a broken blue line (the bit they are claiming)Google maps show that no fence on their photograph but I have been unable to date this, but looking at development around ( I already live in the neighbourhood) I should think the photo for was taken late 2007, so the fence has gone up since then. The other neighbour is not a neighbour in the conventional sense but a previous owner (the one who sold it the time before last), but good friends of the other neighbour in situ

  • To Clutton the title deeds (2 seperate title numbers) to the cottage and the barn with the planning permission are in the banks possession The neighbour who is claiming the garden says he bought it off the last owner with cash and work but he would have been in no position to sell it without the banks consent

    I was reading the other day that the Ordnance Survey people literally monitor the whole country all of the time.... so (it'd cost) it would be possible via them to be able to prove when the fence went up.
  • Do OS people take photos like google. This property cannot be viewed from the highway and there are no other neighbours to verify anything
