Duty of care by Train Operating Companies?

A friend of mine was told his rail ticket was invalid, incorrectly. He was chucked off the last train and BTP sided with the rail staff initially.

However eventually it was discovered his ticket was valid and he was able to resume his journey, except the last train had gone.

In the end he did get a taxi back, however, he had previously been told by BTP that he would have to make his own way back - by walking if necessary.

He is under 18 but over 16. He told them they had a duty of care to under 18s. The BTP officer said no they do not, it's under 16s only. Was he right? Surely not...?

I'd expect someone who is 16 to be able to fend for themselves. Virtually all 16 year olds like to think they're adults so here's him being treated like one.

Don't think he's right however I'd probably pursue the train operator for reimbursement of the taxi fare home

Most people have a mobile phone. Why didn't he phone home to get someone to pick him up?

He should write to the train company asking for an apology and his taxi fare and train ticket costs to be reimbursed.

May he didn't have a mobile phone, maybe no-one was available or able to pick him up, anyway that doesn't alter the fact that the train company were in the wrong.

This is usually about the point I find out my phone battery is dead (damn you, smartphones!) :rotfl:

    Hardly the point is it.

I would write a letter seeking reimbursement and a formal apology (as the ticket was valid).

I really wish there was a 'No thanks' button! That's really helpful - not!

The train company paid in the end as it was finally accepted that they made a mistake.

About 200 miles is a long way to pick someone up, just because some rail staff don't follow the rules!

    I agree :)

And yes he will be. But he also wants to complain about his treatment by the BTP.
  • The BTP were right in this instance. Over 16 they do not have a duty of care towards you.

though as a company having made an error
i would have thought the least they could have offered was a phonecall
    regardless of 'duty'
