no it was not irresponsible banking from hsbc.....but irresponsible spending from you.
You have no case whatsoever....you've spent the money...you know what is coming now...pay it back!! That is what I call duty of care towards your creditors.0 -
Agree with stephane here....you were the one that spent the money....you cannot blame the bank for that.
They did not reduce the limit so why did you not advise them that the cards upper limit still was active?.....& why did you carry on using it?
You signed the agreement agreeing to the reduction in the limit....therefore your part of the agreement should be to adhere to that too.
As for enforceability....no comment.0 -

I took out a debt consolidation loan 3 years ago for 14k and had credit card debt of 10k. The loan conditions stipulated that my credit card limit had to be reduced to 5k. When I went back to complete the paperwork it was a school leaver and she did not reduce my credit card limit. Since this time I have maxed out my credit limit to 14k. Yes I did it, but...... Was that irresponsible banking by HSBC in their duty of care? Do I have a case to try and make both my loan and credit card unenforceable?
I should also state that reduction of my credit card limit is on the loan agreement
