Mattress Return Distance Selling Regulations

This thread reminds me why I wouldn't buy any item of furniture online without trying it out first. The internet is a great way of price checking but in my opinion, most shops will either match or beat internet prices anyway. I also include large electrical items in this too, I like to see, sit, lie, watch, hear and touch. If I see a sofa I want to sit on it, how I sit at home (shoes off of course). If I see a TV I want to know what the picture's like as well as the sound. If I see a bed I want to sit on it, lie on it and turn over on it.
If something is wrong after I have tried and looked, then that's my fault. So each to his own.

What's Tim's libel claim all about?0
-
Supposedly because I said he did not want to provide a refund. I stand by that as he said the following:
"You will get your money back once you have returned the goods. However you have made it quite clear that you have no intention of returning the goods"
This is clearly untrue as I simply want my money back - why would I hold on to a mattress I do not want. I simply wanted him to collect the goods as his Ts & Cs do not suggest to me that a customer is responsible for this.
The case as stated was that he wanted me to return the goods before supplying a refund and he wanted me to pay for return of the item. I said due to his terms I am not responsible for returning the item. He said he would not refund until I return the item
None of this is a lie. It is fact therefore no libel.0 -

You have missed the line based on the information given. I am aware that there are always two sides to a story, but we can only give opinions on the information in front of us, and the OP has presented a calm and reasoned case as to why you are in breach of the DSR's.

You are aware of the complexities of a defamation case, aren't you?
Probably not.
Tim,
1000 people have viewed this thread so far. How many of those people do you think want to buy a bed right now? Let's say a generous 5%. So from those 50 people how many are likely to buy a bed from a website like !!!!!! Beds as opposed to the major retailers and hundreds of other small online retailers? In theory the figure should be far less than 1. Even far less than 0.1. In order for you to believe you have a claim for defamation there would need to be a hugely disproportionate number of MSE users compared to non MSE users across the country interested in using your company. If you expect a significant amount of business from using MSE then surely you are touting for business here?
And in any case I have stated the truth backed up by over 100 emails.0 -
Yes, as a result of using forum and the fact that the advice appeared to be genuine. I had narrowed it down to a make and supplier the only thing I had to do(which I always do with online purchases) is to do a thorough review search on both and then decide based on reviews(or lack of-which is usually a good sign with retailers) Although must add that sometimes even if I come across a 'bad' review I may still buy if I believe that issues raised are either trivial or I am confident that I can deal with them.0

Devildog,
Tim seems to have good feedback generally and the majority of people seem to be happy so you should be ok.
I really don't understand why he had such a problem with me.
Having said that I would not buy from anywhere without trying first for a mattress after my recent experience.0
