    Not true.

    It is up to the tribunal if they accept it or not, their rules of evidence as not as strict as a normal court, and its down to reasonable doubt.

    A previous tribunal has accepted covert recordings before.

    Editing / doctoring audio recordings is not particularily easy, it has to be born in mind the claimaint is usually poor, and does not usually have a track record of dishonesty, unlike ATOS/DWP which are very well off, and do have a notorious track record for dishonesty. And if there was doubt, a professional could test it, and the DWP/ATOS have enough money to have things professionally tested if need be.

    But that would not likely be an issue, they could raise it, but I doubt they would be taken seriously, and as I say, it was not an issue in a previous tribunal which did accept covert recordings of employment meetings without any problems.

    I myself have covertly recorded before - and told the DWP - the reconsidered [and changed their mind, reinstating benefit] simply on the grounds that I had the recording and could type word for word what was stated at the assessment - they did not even bother to ask to listen to the recording...

    You could put in a freedom of information request (its free) via http://www.whatdotheyknow.com/
    to ask the DWP for a copy of the DVD so you can see what it covers, should be interesting.

    Announced on the BBC news the recommendations of a report instructing substantial changes to how they are done will be now used. Perhaps good news for some.

    Nope. I did mine covertly, and in my submitting a written statement including my reasons for recording it covertly, the tribunal have accepted it.
  • I have ASD/Aspergers....trust me, a distance learning module and a DVD is not going to help anyone deal with me!

    I am really dreading the day I get my appointment. I will have to take two people with me - my mum/carer (I don't go anywhere without her!) and a representative from DIAL (they have told me they want to represent me when the time comes)....I am an elective mute. I occassionally talk to my specialist (but for some meetings I am silent) and don't speak to my GP...there is very little chance that I will talk to the ATOS representative!

    Makes for an interesting (if long) read. Addresses many of the issues that people have found fault with. More to be done, but a good start I feel.

    I received an emailed letter of thanks from the review team signed by Professor Harrington.

    I submitted evidence to the review on my own behalf and on behalf of the organisation I belong to.

    Its been a 2 year struggle to get this process addressed, and I'm sure we're still in the foothills, but I'm so relieved; most of all on behalf of those who would have been sleepwalking into this dreadful process; the people migrating from IB to ESA!!

    It's has been a long 2 years and I am sure this is not a time to relax and say, everythings going to be alright now. I'm sure that this report will provide government with a rationale for "a thorough shake up". On what Ive seen so far, this will not be good news given that Grayling has stated that he will be looking closely at the appeal system.
