Banging my head against a brick wall

My husband and I are up against a brick wall and desperatly need some advice, I'm really hoping that somebody can please point us in the right direction.... Ok

My husband split from his ex wife 15 years ago and has always had full contact with his 3 children and paid CSA. (He opted to pay CSA from his wages)

Two of the children are over 19 and we don't pay for them. The last child is 17 and started working full time in August. We were expecting the payments (£250 per month) to stop when we advised the CSA of this but have since had a letter stating that nothing has changed. We have sinced found out that his ex wife is still claiming child benefit for his son!!! We have spoken to the child benefit agencey who will not discuss anything with us, the CSA will not except any information from us and are waiting for child benefit agency to contact them. The ex wife will not declare that her son is working. To top it off his son is currently living with us.

We received a letter today saying that the payment is now going to increase to £500 per month. We are at a wits end!!! We are in a position now where we are paying child maintenance for a child that is working more that 37 hours a week, and is living with us.

We are at our wits end and would really appreciate it if somebody can give us some ideas on how to fight this.

We intend to go to our citizens advice, and even contact our local MP if we have to. Any replies most welcome.

    This board has a CSA sub section and maybe you would have better results their?

    So if his son is living with you, you put in a counter claim for child benefit ;) Might not do any good but will certainly put the cat amongst the pigeons, and maybe just maybe the child benefit office will sit up and take notice.

    Can you step son write to the child benefits forwarding proof of employment?

    Get the son to write a letter, headed with the address of your home (just to make it more obvious!) and sign it writing about his job (hours and that he isn't in full time education..maybe including some job documentation as proof) and address, signed at the bottom. Maybe ending with 'please respond to this letter by contacting me at my father's address where I reside full time' in case someone is a bit slow reading it. His national insurance number and date of birth might be useful too in order to locate him. Send a copy to child benefit, csa, tax credits? Pop a letter in from yourselves too stating the same situation, signed. Send recorded delivery and keep the receipts. Wait patiently for excrement to hit fan on other side.

    You are paying her for him living with you? Jesus. What a horrendous woman. Good news is it's fraud.

    If you want something done about anything, send recorded delivery letters. No matter who you speak to in life, it is rare anyone ever remembers you called, notes it down, has the same person working there...be they insurance companies, supermarkets or probably the CSA. I just skip the futile calls now and send letters, plus it is cheaper.
  • Thank you for your replies, I was thinking about writing a letter to all the agencys and putting as much documentation with it as possible. I think this is the way forward at the moment. Getting a letter typed from my stepson is another good idea!!!

    It's so stressfull dealing with these agencies especially when most of them have such a snotty attitude!!

    and maybe report her to the fraud hot line? I think they have to investigate don't they?
  • contact your local mp...http://www.writetothem.com/ and get him or her involved they tend to listen more to them than you.......and good luck....:)

    Why would they still want maintenance if child is working full time? My husband has a child in Australia and once he started work at 16 all payments ceased. I think their system is a lot better - no one seems to get away with paying anything over there. But you should definitely not have to pay now - that's ridiculous.
