Sale of goods act gives you the right to return it for repir or replacment, but thats down to the retailer to choose. You cannot demeand a new phone if the retailer is attempting to repair it.
The LG Chocolate is quite an old phone being released in 2006/2007 so if you get offered a replacment you should get a phone of a similar spec, but you don't have the right to ask for the latest smartphone.
Have you tried contacting LG direct to ask about a repair, they don;t have to accept it back as the contract is between you and CPW but they may take it back and look at it.
You may not like it but your issue is with CPW, try emailing the Charles Dunstone, he won't reply but someone in the executive teams will, I don't have the email of the top of my head but someone will supply it.
Orange are correct in that your airtime agreement is for line and service, the phone was supplied by Carphone as an inducement to take out the contract.
Cancelling the DD is not a great idea, your putting your credit record at risk. You may be better explaining to them *calmly* the issues and see if they will refund you something as a goodwill gesture, remember though that is a good will gesture. Orange supply you with the ability to use the airtime, it's down to you to have a phone that can do so.0 -
I would say, you've had your money's worth, time to renew. Stop being a tight wad and pay up for a new phone, you dont get nowt for nowt in this world0

Lupin5. I wouldn't usually draw attention to spelling but "Carphonewharehouse" in your title either has a superflouous "h" or an "a" that should be an "o" ! :rotfl::rotfl:
Ignore Alix37's uninformed rant. Only been a member for 5 minutes and clearly hasn't read forum etiquette. (The purpose of this forum is to help people, not just to have a rant with your 3rd post).
As you haven't said how old the handset is, he isn't in a position to give an informed comment and, if CPW are trying to fix it or offering a replacement, then it will be under warranty. It may be an old model, but if you have only purchased it new in the last few months, then it has full warranty.
If the phones offered as replacements are of a similar vintage, then take one. Remember the main reason you have got a phone and it is not primarily a fashion accessory!0 -
