If you were the only one to ever come to court for a single offence like this you would quote Motabilities comments then go and celebrate your win over the silly !!!!!!s who prosecuted it.
As I said I would never be in court in the first place. As I personally place more store in what the DVLA say rather than a charity.
But I would love for a case to go to court and be high profile in the media, And see who wins as I think that would put an end to threads like this on forums.
Oh and by the way my husband is entitled to mobility car so I could be swanning around in one if I wanted to. But for us the maths don't add up. So before any suggests I am jealous :rotfl:

Just remembered. There was a TV documentary a couple of years ago about spouses of Motability customers using the cars fraudulently (as taxis). Presumably there was some sort of identifiable benefit to the claimant, but their other halves still got done!
For goodness sake - buy the car legitimately, pay the tax and clIm the lot as a business expense. Your OH will still receive her DLA, which she can spend as she wishes.C'est le ton qui fait la chanson0 -

The rules are clear, you are not taxed, ergo, not insured. Btw, motoring offense fines are not tax deductible.
If you used your hypothesis, anyone could use a motabilty vehicle or tax exempt one for any purpose arguing that it had a benefit on the recipient in the end. As the direct.gov website says, you are not covered.
I find it a trifle amusing that someone would want to try and go for such a small amount of benefit through tax mitigation, then argue or claim they have no accountant. Any decent one would normally more than cover their fee's with the allowances they would make you aware of to negate the cost of engaging them. What are you discussing? £32?

An untaxed car does not negate your insurance and the general hypothesis is a Daily Mail one.
We are talking about 'abuse' of the system like its some form of low level anarchy, its the Road Fund License - which starts at £00 up to not a lot, for goodness sake, the Police have more common sense to prosecute someone who is on the RSA insurance and maybe just going to the shops without the leasor.

I await with interest on what DVLA say as it seem motability often give poor advice regarding use of car and who benefits etc. As such I do worry that a lot of people are not knowingly doing wrong. I even worry that I have my tax exempt disc and I am sole driver 99% of the time but what happens if for example a friend has to drive the car home for me if I'm kept in hospital after an out-patient appt. Cant leave it at hospital and so it has to go home. Its certainly for my benefit to get car home as it prevents huge fines and car being towed in London.0

I sent the DVLA an email and they responded with a return email telling me I can phone to ask or send a letter. I decide to send a letter because I'd have no proof of what was said in a phone call. It's a bit pathetic that I can't send an email to the department that can answer the question via email
I guess it'll be at least a week before I get any response from them.
The only way to get proper answers is to go to the source and not some of the folk on here who seem to take everything lying down.
I do wonder why this hasn't been taken up by large numbers on here as it's a group of folk with a vested interest.
If I get an answer that is stupid i.e. as their web site say's I'll take it further. Someone on this forum said I must have too much time on my hands, but, I rarely watch TV so I do have time to fight causes I think need fighting.
I hope I can give you good news soon but don't hold your breath, I think it'll take more that one letter from one individual.If we evolved, why do we die0
