Claiming mobility allowance against tax

My wife is disabled and gets mobility allowance. We used the mobility allowance to buy a car because I needed a car for my business. (I'm allowed to use the car for work because she benefits from it) I could have bought the car using money I earn from my business and if I had, I could claim the cost as a business expense. Can I claim the cost of buying the car as a business expense even though the government pay the benefit. I know this sound penny pinching but I don't earn a lot because I need to be available for my wife's needs and therefore can't devote a huge amount of time to my business, but it's better that being on the dole and I can hold my head up knowing I'm doing what I can.

I suspect the answer is no as you dont actually pay for the car your wifes dla does,do you have an accountant?they could perhaps advise?
As for using the car for business,personally i think thats strecthing the point a bit tbh0 -

As for using the car for business, Before we agreed to get the car this way I had a discussion with the mobility people and they said that as my wife benefits from the income from the business I can use it, the same would be true if I had a job working for someone and I wasn't self-employed. If I go shopping the same applies. The only time I couldn't use the car would be if I used it solely for my use and she got no advantage from me using it.
I'm going to look into trying to get out of the contract and me buying the car using finance. That way I could claim the expense and it would make a big difference to our finances.If we evolved, why do we die0 -

It has nothing to do with mobility but everything to do with Swansea because your are illegally using the disabled tax disc and you can be prosicuted for doing so or so they said in the letter that they sent us after someone told them my husband was using my car (not mobility but taxed using my HRM exemptsion) for work, something he only ever did once after his car was damaged in an accident, I need my car at all times and he only had my car a few hours but thats enough for someone whos already got the green eyed monster.
There was also an article in the local paper a couple of years ago about the council prosicuting people illegally using BBs and they also reported these people to Swansea for having no car tax because the cars had disabled tax discs on them, no disabled person, no car valid tax tax.0 -

I'll check again, but it makes no sense if I can't use the car for her benefit. It might be that the powers that be have realised this.

This would very much be seen as taking the p*ss I suspect. You buy the car and and pay for it with money using the taxpayers funds, and then want to use it as a business expense to avoid paying tax?
You then drive around in a car with free road tax whilst other able bodied road users are forced to pay.
You seem to be after a free ride in more ways than one would be my view0 -
It may be seen as take the p but if I have the legitimate right to make the claim I'd be a fool not to. There's lots of areas where folk claim what some would consider "ifi" expenses, but the expenses are allowed because there legit
PS a free ride would be taking full advantage of my wife situation and staying off work permanently (I was given the opportunity) This, (that would cost the country a lot more) I refused to do and I now work, holding my head up high. I'm not a lot better of as a result, in fact in some areas I'd be better of not working but I've always had a work ethic.
I work a minimum of 35 hours in my small business and I also have to look after my wife who can't cook, do house work, wash herself, etc etc.

You are illegally using your wifes disability to obtain free car tax and I hope that its you in the paper next time, they name and shame you as well as fineing you and possibly sanctioning your wife for allowing it to happen.
If you can hold your head up high while illegally using your wifes disability to claim free car tax you cant be honest or proud.
Who gave you this oppertunity to give up work perminantly?

your wife has to benefit from you using the car without her(e.g getting a prescription for her),at all times and directly not indirectly as in benefiting from your income.
you are hearing what you want to hear and NOT what they are telling you i`m afraid,and you ignore the rules/law at your peril.0 -
I find all this fascinating. Before My wife got the car I was against it because I couldn't see the point of getting a car because I would only be ably to use it when she was with me. Because of this, we phoned the mobility office and we were both told (using a speaker phone) that if I go shopping my wife gets benefit from that and also therefore if I go to work my wife gets benefit from it. I pushed the point about me using the car for work and we were told again that I would not be breaking the rules using the car for work. I have used the car for these purposes but now I'm wondering If I was given bad advice. I never use the car for my own use if my wife isn't getting benefit from it.
Thank you woodbine for the advice, I'll be writing the disability office in the morning and I will post on here with a summery of there reply as soon as I get one.
As for sunnyone your not a very nice person are you, I've used the car innocently and you would like to see my and my wife punished because we received bad advice and then acted on it, shame on you. I don't tell lies, I was given the opportunity to not work and look after my wife permanently but I refused to live like that. As for leaving my wife for 35 hours at a time your assuming I go out to work, I never said that. I work mostly at home and that is the reason I'm on poor pay, and that is why I'm looking at way to lesson the burden by claiming all I can in tax allowances. Why are you such an unpleasant person. Don't assume anything about me and please don't respond to my post again if you can't be constructive.If we evolved, why do we die0
