if they didnt ask the question they cannot use it as a reason to cancel the policy, however check the website regarding assumptions as it may be covered there.
If THEY have cancelled the policy they MUST refund you on a pro rata basis regardless of the claim, otherwise INS companys could cancel every policy after a week and keep the money.
CAT D lossed are the lowest rated and as such is usually minor damage (bodywork,glass etc) Insurance companys if advised that a car was a cat d would ask for a VIC cert & a report from an engineer to confirm the car has been fully repaired etc.
I would ring Swift as they should also be dealing with the TP. Start a complaint and mention the FSO if there is no mention of declaring total losses etc.0 -
I got the insurance from a comparison website - it didn't direct me to their own website so I never saw that they didn't insure cat d cars - I would definitely NOT have taken it out under false pretences.
The FOS has very clear rules on disclosure, have a read of http://www.financial-ombudsman.org.uk/publications/ombudsman-news/46/46_non_disclosure_insurance.htm and maybe give them a ring to see what they say0
