What about the Flip side to this, if Apple have no trained us on the device how we supposed to be able to offer support?

It's all well and good saying we have to but we need the tools to be able to. So without the tools that apple have not provided us with how can we?

You also know Apple do mystery shops to make sure people are following their rules right?

I understand about the support having to be done by Apple, but this is getting away from the point.

The law says that the retailer is responsible for the delivery of the contract to their customer and the responsibilities that go with it. You have to resolve the problem with the customer, not Apple. If the resolution means that the fault has to be diagnosed and repaired by Apple, then that is fine.

But if Apple, say, lose the phone or take too long to resolve the issue with your customer, it is down to you to put things right by either a refund or replacement. That is English Law.

Getting back to OP, I still believe that they are entitled to a refund. If they were in USA, Steve Jobs guaranteed any dissatisfied customer could return Iphone for that very fault within 30 days for a full refund. Vodafone and other networks should not be selling the wretched thing until it is sorted and works as well as any other phone on their network.

Irrelevent. You as a retailer sold the device, if the customer wants you to fix it you have to fix it.

How you do it as a process is down to you, as I said you may simply have to send it Apple and it would have been faster for the customer to do so directly, but you still have to do it.

Your reseller agreement with Apple would I assume give you access to the ability to log a call for the customer and I assue thats what you would have to do. Apple cannot over-ride the UK law regardless of what they wish.

Vodafone are, in my opinion, to be avoided at ALL COSTS. Nightmare of a company. Did you guys see the demonstrations about them?

So you just looked at the banner they were holding and believed every word? What an idiot...

Even HMRC say that Vodafone don't owe anything like £6 billion. It's just a figure made up by a bunch of hooligans to tarnish their name. And no, I don't work for Vodafone, or any other network or handset manufacturer or technology company.

  • I don't understand this "Well only Apple are allowed to deal with issues so SOGA does not apply." Absolute rubbish. I work for CPW, the retailer who has been selling the iPhone the longest. If an iPhone goes faulty, we act as a courier and send the phone off to Apple on behalf of the customer. We set up every iPhone in store before they leave as the sim cards can be tricky to insert. I have not heard of these "rules", nor has my colleague who has been with Carphone since the launch of the first iPhone. If we'd been breaking these rules, why have we been allowed to sell the iPhone all this time?
Have I helped? Feel free to click the 'Thanks' button. I like to feel useful (and smug). ;)

Why order a phone that has known issues? Too eager to follow the sheep.

Presume your ordered it knowing you can return it because of this known fault but left it too late.

When vodafone sent me a different phone to the one i was enquiring about they told me as long as i dont insert a sim
    there wont be a problem.
The way they worded it to me was inserting a sim rendered the 7 days return inoperative.

I like my nokia, Screen maybe a bit laggy compared to the iphone but its a LOT cheaper and i can make calls with it.
