Earlier this year i had a bad leg so went to the docs and was told it was probs arthritis and told to take ibuprofen. My condition did not improve infact it got worse so i went back and had an xray which confirmed mild arthritis in my hips. The gp then sent me to a specialist who said i would need my hip replacing (left hip) but i was too young yet and should go back to my gp for painkillers and he would see me in ten years for an op! The doc gave me paracetemol but after two weeks of bad pain i went back and got some naproxen. I also take co-codamol most days and have permanent pain. I walk with a permanent limp and cannot walk anywhere without pain. For that matter i am constantly in pain even with the drugs.I walk as little as possible due to this.
I applied for DLA and was refused so i appealed and was refused again ,I am now appealing again. I dont claim sickness benefit or anything else and dont think i am putting the correct things on the form.can anyone give me some advice as to what i should be doing?

What were the reasons given for your refusal (initial and appeal)?
Have you got copies of the information which was used to make the decision?0 -
What are your care and/or mobility needs?0

Go to your local CAB and ask to see their benefits adviser. The one who helped me took what I had written on the form and tweaked it to fit what she said they accept. It was very easy to arrange and she actually came to see me at home which was brilliant. When dancing with dragons, don't let your partner lead.0

i filled the form in online and did not print a copy.
They also said they had a medical report from the doctors which i have not seen. Can i ask to see these?Make £11,000 in 2011 / ebay £6000 -
It is explained in the first post. to be honest it is not the care i need but i do have problems with mobility.Oldernotwiser wrote: »What are your care and/or mobility needs?Make £11,000 in 2011 / ebay £6000 -
You should get all the papers issued to you now you have made the appeal - this will include the application form, any evidence they got from your GP or consultant, as well as the reasoning as to why you were deemed not to qualify. You can ask for cooies prior to the papers being issued. When you get the papers there will be an enquiry form you must complete to say you wish to go ahead with the Tribunal. It is worth getting a representative now either from the local CAB or your Local Authority may have a Welfare Rights Service who will assist - the rep can get additional supporting evidence to help your case and pick the flaws in the DWP arguments and use case law to help you.0

I believe you can request a copy of your application and a copy of the medical report. On the award letter it usually give you a brief reason why you were turned down - it is usually listed reasons. When you appealed was it through a letter giving a full account the reasons why you disagreed with their decision?
When I re-applied they sent for a report from my GP (as they have done on previous occasions) but I have never received a copy - I don't believe this is done unless you ask for it.
Oldernotwiser asked you about your mobility and care needs which you replied :
Your first post does not describe your mobility problems, yes you are in constant pain and avoid walking but hopefully you went into more detail on how it affects you on the actual form - you need to give an account and examples of how it affects you everyday with different situations. What you wrote in your first post would not be adecuate, so I can see why oldernotwiser asked you about your mobility and care needs. It is explained in the first post. to be honest it is not the care i need but i do have problems with mobility
If you have such difficulties in your mobility then it affects your care needs. Have you seen your GP or specialist to ask what he/she wrote in the report?0 -

You mentioned being in pain but that isn't the same as having a mobility need.0 -
Hello,
I'm not being hard or unsympathetic, but are you seriously saying that you have mobility needs severe enough to qualify for even LRM?
confirmed mild arthritis in my hips - is with respect such a common ailment that I would imagine that over 30% of the population have it!
I cannot find words to help you but on the other hand maybe your name - Hopeless Case - answers it for me!
May I suggest that you stop wasting your time, that of your GP and certainly that of the DWP/DLA staff.
There are many out there that have a severe case of the hips, knees, fingers, wrists and neck that don't even manage to secure what you are attempting. I know, I have a friend that suffers from these disabilities and after two attempts has given up at the suggestion of her GP!
I know what you are saying and mild arthritis does not sound bad.
I have no trouble from my right hip at all but my left hip is another story. the movement in it is extreemly limited. I have to lift my leg into the car as i cannot get it in on its own. I also cannot cut my own toe nails on my left foot nor can i put my own socks on i have a permanent limp and have an more than one occaion had to be helped home when my leg has totally given way due to muscle spasm. I do not claim any other benefits and am no sponger i was advised by someone to claim this ( a friend who is a nurse).
If this is not classed as mobility problems then i wont qualify.
I wish i was not in the predicament that i am in but alas that is not the case.Make £11,000 in 2011 / ebay £6000 -
