Summons for court appearence

    Hi

    My friend already has 9 points on his licence. He was caught speeding and had to provide his documents to the police station, which he stupidly forgot to do. He then received a court summons, he decided to plead guilty by post and sent form off with his licence. It appears that this guilty plea and licence turned up at the court late after the case was heard, and he now has to go to court again next week.

    Does anyone know what the likely outcome will be? Im guessing more points and a fine, but could he be banned and if so for how long? He needs to drive for work as he is self employed plumber and also to pick his children up when they come to stay with him (he lives 45 miles away and has them half the time).

    The speeding is going to give him an extra 3 points (at least - depending on the speed) and will give him an automatic 6 month ban for reaching 12 pts (assuming they are all within the last 3 years.) The only way to avoid the ban would be to attend court and make a plea that the ban will cause excessive hardship (to others not himself).

    another question, when refering to application forms is the offence classed as a driving conviction or is that for when your banned from driving or caught for drink driving

    You will not be offered 3 points and a fine for 61 in a 40 but will be required to attend court. Is the charge speeding or is there driving without due care as well?

    The offence is a driving conviction. 3 points from a fixed penalty notice is a driving conviction - anything you get points for is. A FPN just saves everyones time.

    Loss of licence. As the kids don't live with him, he cannot plead on the grounds of hardship caused to innocent parties.
  • I would expect (if no previous offences) and you plead guilty in writing with an apologetic letter 4 points and a fine of £150-300 depending on salary.

    As long as you don't drag out the case or try to blame others your looking at a low penalty although a bit higher than the FPN you expeced. Technically once your over 50% your looking at a ban but its very unlikely.

    If they have called him to court they are considering a ban. He needs to get a solicitor and plead a hardship case to keep his licence. Whether it suceeds who knows.

    Not showing up wont go in his favour. I reckon if he needs it for work and it isnt overly excessive he'll get 3 points a large fine but to keep the licence.

    lay it on thick , mention all the charity work you do and how your elderly relatives rely on you to do their shopping will help
    if you look at all the footballers who get off with just a fine for doing over a ton then i'm sure the judge will have sympathy

    i wouldnt lie but i would allow my solicitor to be creative ;)
