Just received my summons for a driving offence in august, i know i did wrong so all i want is advice please and questions answered(but i cant control the replies). I was expecting something to tell me i was getting 3 points etc but not a summons. The letter mentions sentence so does that mean jail, id rather pay a fine and get 3 points so is it best i go to court and plead guilty. The letter mentions about a discount for early plea of guilty and any discount depends how early i enter my guilty plea but would i still go to court for that.

thanks for answering

Think ill do it by post and be done with it, is that a good idea

Might help if you said what you are alleged to have done ...?

    Did you do it ?

And no, "sentence" does not mean jail - it just means whatever the court decides to do.

Its a conviction... or rather it will be if you are found guilty.

OP, you may wish to post on pepipoo.
  • At more than 20mph in excess of the speed limit, you are beyond the point at which you can be dealt with by a fixed penalty notice. A court summons is normal in this instance.

The options available to the court will include (but are not limited to) a fine (likely to be more than the standard £60), penalty points, a combination of both (the most likely outcome) or a suspension from driving. You will also be expected to pay court costs if found guilty.

DO NOT drive there, They may ban you for a short term, Ban effective immediately. So many people drive to court
get banned then get caught driving home.

Have you taken legal advice? You may want to defended, Just to stop them slapping a silly ban & fine on you.

At that speed the magistrates guidelines would be between 4 and 6 points , and a fine using a calculation based on your income. An early plea of guilty should get you a third discount on the fine... but not on the points.

Assuming a clean licence, and no other factors, a ban (although possible) would be extremely unlikley.

For 61 in a 40 your looking at 4-6 points and a fine in the region of £250-450.
