Squeaky boots!

I bought a pair of boots on the 29th Sept and they have since started making a loud squeak from the sole. They aren't squelching from being wet, this is a rubbery squeak that happens all the time now so to me this is a manufacturing fault. I want to return them for an exchange and I still have the receipt. I rang the manager who didn't seem to have a clue, he just said 'i don't think that sounds like our problem'. It's a really loud squeaky noise that is completely embarrassing and I feel the boots are not up to the standard I expect from them. Can anyone please explain to me what my rights are on this matter?

    Take them to the store and demonstrate the problem.

    I just took them down and the manager said the same, that he didn't think it was their problem. He said he would have no idea how to process an exchange with the fault listed as a 'squeak'. I gave him a copy of the Sale of Goods act to read over and explained I felt it was an inherent problem in the manufacturing. He still didn't know how to proceed. I asked if the problem was that he simply didn't know what to list as a problem! In the end we had to put down that I was unhappy with the products finish and appearance due to some visible glue on the suede.

    So ended up with a replacement but had to give a completely different reason to the actual problem! Hope it doesn't happen to this pair!

    The manager sounds like a bit of a plank.

    Oh dear....

    are you oh dearing at me being cheeky by doing this? (which I admit it kind of was!) or at the fact that it was necessary to show him a print out? lol

    Can anyone tell me if I was actually in the right in the first place? I know I got the outcome I wanted so it's kind of a null thread now but just incase anyone else has this problem in the future!

  • To answer your question as to whether there is a breach of SOGA is difficult and all depends if the boots were faulty (i.e. not of satisfactory quality within the meaning of s.14(2) of the Act) or not.

    After speaking to him on the phone I felt I had to some him something in black and white to try and change his mind. He declined to keep it!

    Did you try paying for them? Tradition has it that boots and shoes squeak because they haven't been paid for!! :p

    { this is meant to be tongue in cheek - I am not suggesting for one moment that you stole them!}
