Railway Parking Ticket
I would like some help if possible.
I parked at Derby Railway Station on Saturday and overstayed in the car park. The ticket machine was broken and has been for some time. I was late getting back to my car because my wife’s train was delayed ,I suffer from Crohn’s disease, a form of IBD as a result of which I needed to use the lavatory urgently and I also suffer from Ankylosing Spondylitis which affects my mobility. When I got to the car the ticket had not been issued and the staff were very rude ,finding my disabilities amusing when I tried to explain and carried on issuing the ticket. The ticket is entitled Parking Charge Notice issued by East Midlands Trains for exceeding permitted time: Contrary to Railway Byelaw 14 or terms and conditions. Should I ignore the ticket, pay the lower rate £35 within 14days or appeal under mitigating circumstances?

The fact it says 'parking' rather than 'penalty' suggests it's a private ticket. Which company/Council served it and who wants the payment?0

Id check the ticket properly as if it was given under East Midlands trains make sure it was them.. A penalty under the railway bylaw should not be appealable
Check this thread here for some pointers.

Does say Parking Charge Notice
Cheques and postal orders made payable to East Midlands Trains0 -
I'd take it up with their Customer Relations Team.

If their (EMT) train was running late, under Passengers' Charter (or Delay Repay, in their case), more than 30 minutes, you get something (at least 50%) of that part of the journey back.
I'd see fit that they cancel the Parking Ticket. If they don't, take it up with Passenger Focus or even the Derby Evening Telegraph, Central news, BBC EMT, etc. Derby City Council Trading Standards might take an interest too.0
