Cancelling contract whilst in 7 day cooling period

Hi all,

I hope one of you can help me out with a possible problem. I have just signed a new contract with Vodafone after my previous contract with o2 had run out. I've now got to ask o2 for my PAC and give them notice that I'm leaving. Whilst searching for a good deal I phoned o2 twice and got through to retentions but the deal offered by Vodafone was still better. What I didn't realise was that I have to give 30 days notice to o2 even though I'm now on a rolling contract. After doing some reading on here I understand that I may again be offered another deal by o2 which could possibly better or match the current one I have been offered by Vodafone.

What I'd like to know is, am I within my rights to cancel my contract with Vodafone, even though I have opened the box, turned the phone on etc? Bearing in mind I'm still within the 7 day 'cooling period'.

Secondly, if o2 do not make me a better offer and I decide to give my notice is anyone able to tell me if I can downgrade my contract for the month to a much cheaper one?

    Where was the contract purchased from? In stite or online?
  • Oh sorry it was bought over the phone. My main concern is that after opening the goods so to speak I have invalidated the cooling period. I'm also confused about the cooling period rules, am I within my rights to cancel the contract or only to change the handset?
  • You can certainly return the phone within 7 days of RECEIPT and cancel the contract with no problems at all.

    unfortunately you won't be able to downgrade your o2 contract even for that one month.

    remember to hard reset the phone before you return it (hard reset means reset to factory settings which wipes all data)

    what kind of deal were you offered? with which phone etc?
  • I have got a free HTC Desire on Vodafone for £30 a month on an 18th month contract with 600mins, unlimited texts, 500mb Internet.

    You should also note that, unless they have changed policy in the last 12 months, Vodafone are the only network that demands that you supply your PAC code at the time of order otherwise you lose your previous number.
  • Guys Dad - I hope you are wrong there as the person I spoke to on the phone gave me instruction on how to submit my PAC via the 'My Account' area online.

    Certainly that was the case less than a year ago. I have checked CPW & subsidiaries' web sites and they have changed their wording and no reference is made to anything special re Vodafone and porting.

    However, I get the following from Vodafone's web site

    Do I need to do anything special to keep my number when I join Vodafone?

    Monthly

    We will need your PAC when you make your purchase online, in one of our stores or on the phone and we'll take care of the rest. We'll give you a date there and then, confirming the transfer will take place in 2 working days.
    Please remember that the date of request may not be the same date that you sent the details to us.
