What can I do now?

Hi all, I hope you can offer some advice!

I won an auction last night for an extremely rare item which I collect and due to the title being mis-spelled I got it at a fraction of the cost. Now the seller is emailing me telling me I have to pay an additional £900 or he won't sell.

I do not want to pay the extra as that is much more than it is genuinely worth. The problem is that I have already paid through paypal and if I don't pay the extra, he said he will withdraw my money and I won't ever see a penny of it.

Any advice will be greatly received!

    Firstly he can't just take your money - if you've paid already he has 2 options.

    1. Send it you at the price you've already paid.
    2. Refund you an re-issue an amended invoice.

    You could ask him to refund and re-issue and then report him for fee avoidance (because he's asking for more money than was fairly bid in the auction), because the only way he can add the extra would be through additional postage.

    Keep any e-mails/messages invoices he sends you.

    Downside: He may issue a non-paying bidder alert on you once he refunds.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

    I don't really care about neg feedback or strikes but the whole mess is strating to upset me! :(:(:(

    Forward the emails to ebay with a 'non peforming seller' report filing - under Help / Contact Us.

    Then do the same for 'fee avoidance'

    You can get your money back via a Paypal item not received complaint if you dont receive it or collect the item. It doesnt matter if it was for collection! He has to provide proof of delivery with online tracking!

    If he has withdrawn the money, Paypal will restrict his account (and anyone closely related to him) until he pays up and also send debt collectors after him!. Paypal will also cover up to £105 themselves (or up to £500 if the item is valid for Seller Protection).

    If he refuses to ship the item then you can take him to the Small Claims Court for 'loss of bargain' for the market value of the item as ebay sales are legally binding contracts.

    Keep all emails.

    I would leave him a Negative immediately on receiving a threat like that.

    Did you pay by credit card? If so ultimately you can reclaim your money that way.

    Meanwhile phone paypal, they might not be able to do anything but at least let them know your seller is threatening to do a runner with your money. Also talk to ebay live help, see what they say, I'm sure someone will post the link for you.

    Sellers like this give the rest of us a bad name.

    Start a chargeback asap.
    You can also report him for aggressive and abusive behaviour/language.

    I think you are mis-reading OP's use of the word "collect".

    I think she means that she collects that type of item, not that she was intending (or able) to pick up this particular one.

    Your solution is a bit underhand anyway as her effective chargeback using this method would constitute a fraud.

    True the seller deserves it, but we shouldn't drag ourselves down to their level.

    It wouldnt be fraud if you sent a cheque! Just like writing a cheque that bounces isnt fraud.

    But you are probably right - it only works if the buyer is collecting (or the seller is stupid enough not to use Special Delivery or a courier)

    I'm not sure a court would agree with that.

    The act of fraud occurs when you say you do not posses something that you do in fact posess with the specific intention of obtaining money.

    What you plan to do in the future may or may not be deemed mitigation but it will not "undo" the fraud.

    Messages like this are disgusting and Ebay should kick them off immediately. As someone else said, they give other sellers a bad name.

    The more I read the threads on here the more disillusioned I'm getting with Ebay.
