Hi ,
I sold my last property 6 months ago and now the person who bought it is re-selling .
My question is can they use my old photographs of how i used to have it ? ALL my furniture and decor as well as personal posessions are on view.
Is this Miss-selling ? And can i complain about this , its invasion of privacy surely?
Thanks for any advise on this.

You are absolutely within your rights to phone the estate agent and demand they take your photos off. It shouldn't need more than a phone call.3.9kWp solar PV installed 21 Sept 2011, due S and 42° roof.

When you say "your" photos what do you mean? If you took them and gave EA permission to use then they should not use them again. If it's the pictures the EA took (and are thus their property) I'm not sure if you can do anything. Your personal possessions were on the original ads and you had no issue, so that's not the issue here is it?

Its very cheeky , the reason i ask is that we are being chased for miss-selling this property (Being contested through solictors at present) and think by using our photos this is actually miss-selling surely?
Admittedly they took the photos and were their property so to speak , but since its Sold then other people who have bought this property have redecorated , new carpets wallpaper ect and looks nothing like our original pictures.
We thought once the property had sold that was it, why wouldnt the new owners have new pictures? We think they are pretending to sell thus not allowing the estate agents in to take new pictures and no for sale sign outside. We think its a ploy to get monies out of us.

Phone the EA. Have a bit of fun with them - tell them you liked the flat when it was on 6 months ago because you especially liked the way it was decorated and the furnishings but you weren't in a position to proceed then. No we didnt , the people who moved in are looking to make some monies and are basically lieing about silly things.. So no we didnt Miss sell ....0

If you took the photos, then they're your copyright, so send the EA a bill for using them! If the EA took them, then it depends what you agreed!!Should've = Should HAVE (not 'of')

Hmmmm ... Would have to dig out the agreement we had, its just wouldnt you arrange a visit and get to the property and think why is this bedroom BLUE?? Not like the pictures, what im trying to say is these people are trying it on and we just want some kind of assuarnce that they cant use our pictures. Why would you use other peoples pics ?? Just plain weird??0

Will phone the EA up and ask them, do www.rightmove.co.uk record their phonecalls? Someone told me they do.0

If you took the photos, then you own the copyright on those photos, and unless you've explicitly given the EA free rein to publish them anywhere and anytime, then you control them. In this case, phone them up and request they be taken down.
If the EA took the photos, then it's borderline Property Misdescription.
However, since you seem to be in dispute with the current owners, it sounds more like them doing it to annoy you, wouldn't you say?0
