Hi all, If you were to fail the medical assesment for ESA and decide to appeal the decission when do they reinstate the payents is it when you first tell them that you wish to appeal or once they have recieved all the paper work for the appeal and do they back date any payments that may have been stopped IYKWIM Thanks for the help and replys incase I forget to thank anyone;):)

    Payment should start I believe when you tell them you wish to appeal. Not sure of the exact details if they backdate the gap between when they get your wish to appeal and them telling you you lost.

    uolypool, if you phone them and state your wish to appeal I believe that they will continue to pay ESA provided that you submit your appeal in writing within 14 days, along with your med 3.

    Thanks for the reply I haven't had my medical yet but just want to get an idea of what happens once I do and what i do If and when I may fail:cool: ,can I ask what is a med 3?

    hi Uolypool,

    I think the MED3 is the sick/fit note, i know it used to be the sick note but i am not sure if they changed it when the fit note came out??

  • Pebbles is correct. It's the sick note and the new fit notes are still called med 3's.

    im in the same situation and sent of my appeal today, i rang them and asked about when my payments would star again, and i was told as soon as they receive it and they will backdate any money owed to you from the date they stopped you money.

    How did you fail the medical???? Surely you passed and are now eligable to venture out into the jobs market. If you failed you would be eligable for benefits.
    Why do people say they have failed the medical when they have been declaired fit to work?
    Ask yourself not what you cant do but what you can do
