If it was from a garage then they're legally obliged to fix it.

If the car was inherently faulty at point of sale they are actually obliged to fix it - six weeks isn't a long time.

Actually getting them to do it... well.

See my previous post - it is classed as a wear and tear item and therefore is not covered under a warranty.

They've only owned the van for six weeks though - it can't have worn from serviceable to knackered in six weeks - so it must've been excessively worn at point of sale.

I'm not talking about a not-worth-the-paper aftermarket warranty, I'm talking about statuatory consumer rights under law.

Exhaust is wear and tear, usually excluded by warranties. I very much doubt you will be covered on an 8 year old van.

If you are very fortunate, garage may offer you part of the cost or free fitting as goodwill.

The garage is unfortunately about 1 and half hours drive away which he cant really do with the exhaust blowing :( I think we shall have to bite the bullet and then argue the toss afterwards. Pain in the butt but thats life isnt it

    Exhausts are consumable items.

It can however have gone from just about servicable to failing in 6 weeks just the same as brake pads and a clutch can. If its been doing journeys round town there's a lot of flexing and movement of the exhaust going on coupled with the fact it doesn't get hot enough to burn off all the condensation on the inside.

    exhausts yes
gets a bit more complex when you get into manifolds with incorporated cats

Just come home to a phone message that the exhaust has split? inside the engine compartment and will need to be replaced completely including the cat.

a manifold that fails in 6 weeks was faulty when sold unless something contributed
eg a failed engine mount allowing flex
of course that would again come under faulty when sold

yep, depending on what was paid for the van I'd say it's a sale of goods issue rather than a warranty issue

He has to get the van on the road for his work, so he has booked it in apparently at an exhaust centre. OH has just gone over to see him and what exactly is wrong. I think it will be a case of having to shell out first though as he will lose too much work otherwise.
