Maybe your uncle is not being financially honest with you?
When my GF died and my parents and I went through the finances (as my GM wasn't up to it), we were suprised. He often talked about being skint, not having money, needing to tighten the belt, but his finances were rather healthy.
Some people don't always tell their relatives everything and if he is being refused then there must be more to it as with only £10K he'd be entitled (even with the additional £12K).0 -
Is the relative who received the money, after your aunt died, able to help out?
I dont have any dealings with this relative at all and i know uncle would not ask, as it was what my aunty wanted (it all stems from how they were very good to her years ago and she promised when she died she would leave her something) - personally i didnt agree, but it was not my decision.0 -

Not at all my uncle is straight as a die, i deal with all his finances for him, he is a very honest man, yes he is private but knows he has to tell me everything as its me dealing with it all. I have done a lot for them all my life, they were like another mum and dad to me, so i know all the details.
I do understand how this could happen in some cases, but mu Uncle is very upfront with me and honest.
There really isnt any more to it than what i have posted..... but they believe he still has the money, but even if he had in my opinion he would be entitled to some help, its just getting him to let me try again, if they spoke to him directly he would say forget it, if he flet they were not believing what he told them, goodness it so hard, but he is eighty odd and is proud and stubborn, not realising he would benefit from this help.0 -
You should get PC with higher savings though - that is why I am confused. Have you rang them yourself?
It could be that his income is over the threshold for PC (and the automatic right to HB and CT), ie his pensions (AA is not included in that figure) and that it is the LA limits for these (low income) that is the sticking block.
If so then they would "take the money he gave away" into account. He would need to be under £16K for this. Again ring the HB people and ask them for advice. They are really helpful sometimes.
Also he does need to get a Social Worker to approve the care. Eg my GM pays £120 pw for her care - The only income she has is £158 a week. They assessed her and because she has a home she owns (she moved into sheltered accommodation due to ill health) it prevents her from getting financial assistance. If she didn't have this home she would have got assistance.
The problem we have is that the home isn't yet sold (so a house doesn't bring in money each week) but once sold she would have means to pay. That isn't the case with you, so again add Social Services to your list to ring for advice.0 -

I am going to contact PC again and explain situation, i understand when aunty died he lost PC as then his savings took him over limit, as he lost some carer premium entitlements??? sorry thats what i think off top of head.
He did have a Social Worker who originally set up his homecare, but now he has no allocated worker.
I can sort of see how he is not entitled to HB + CTB as they will still believe he has more money than he does, but care charges he should qualify for.

Is suspect that his income is over the threshold for PC.
When the OP posted first of all she said that her GF was receiving state pension and a small private pension.
Now, a couple of years later she is saying that he receives State pension, small private pension and industrial injuries (benefit I presume)
Without knowing the figures it is difficult to speculate. That is why I suggested that she put his figures into the turn2us calculator to check.
Certainly his savings (even accounting for the money given away) wouldn't make him ineligible for Pension Credit (and a passport to HB and CTB.)
But if he is not eligible for PC then his savings do, at the moment, make him ineligible for HB and CTB.
I am sure the Welfare and Benefits advisor will be able to help.

They said their income was £275 pw - so I assume this is too high for PC.
The problem (from their SOA) appears to the high care fees. I would think that Social Services *may* be able to help with this - but they'll no doubt do their own financial assessment. From my dealings with my GM I think it is approx £25K in savings that is their limit.
I agree that the income is too high for PC (but don't know if that is due to none countable income - Ie AA and others?). Makes sense that is why they said no.
The savings will be too high for "income related" HB - But again it depends on when they last applied and how much notional capital they removed. It could be that enough time has passed, as they are under the £16K now.
I'd personally be asking re the care fees - because if they can pay those then they will have a reasonable amount to live on.
But I know very little of this area and I agree someone more specialist should be able to help.0 -
