hiya boobless you are like me as in getting in a muddle but what i tend to do now is write things down that i want to say and have my list of things ready for when they come. dont know if that would help you , but because usually what happens to me is "oh i wish i'd said that!" after they're gone:o 1st and formost DONT GET STRESSED OVER IT:p0

What you have to make clear to them is that your household is you and the two children. Perhaps you need to have a formal contract with BIL as a lodger, there are people who read this forum who have mentioned it before. They will want to know what he is paying you to stay there and on IS you can keep a certain amount. You could phone Shelter on his behalf (or he could) as he is potentially homeless, they could advise on contracts etc. With the Council Tax Benefit you receive you will need to inform them and there will be a non dependant deduction made from the amount that you receive. This is dependant on the non-dep's income so you will need to ask unfortunately in order to sort this out. You would then ask him for the amount they have taken off you. If you don't stress that you are a seperate household they will be wanting to look at his income as supporting you and getting you off Income Support.Torgwen.....................

silly question, would a formal contract have to be done by a solicitor (not a problem) and would he have to pay me anything, i was hoping he could just help out with general maintenance things that its not possible for me to do anymore, thus helping him to save a deposit quicker, or is that false economy. he has his meals at his workplace. At the moment he is staying with his elderly father (88)sheltered, and sleeps on an airbed in lounge, his travel to work from there is around 1 and half hours, here just 20 mins.yes you can beat it :j - everyday is a bonus - use it well0 -

Please try not to stress out about this situation too much with regards to the I.S. The visting officers have done these kind of interviews many times and it will be clear to them when someone is a lodger and when they are a partner. Unfortunately they are just procedures that have to be followed. One word of advice though, they will make notes throughout the interview and ask you to sign something at the end, make sure you read what they have wrote and don't just let them read it out to you as something you may have said innocently could be misconstrued.
It will definitely go in your favour that you contacted them to sort the situation out though and you'll probably find you'll have nothing to worry about.0 -

My (now) husband's flat mate (female) had a visit from the DWP when she made a claim to IS when he was sharing a flat with her. They visit just to ask specific questions about your living situation - e.g. food arrangements, money arrangements (such as if he were to move out, would you move with him, would you consider yourself financially reliant on him etc), whether or not you socialise together. These are the sorts of questions they ask in order to determine whether a couple are living together as husband and wife. You should have no problems - my husband's flat mate got her claim allowed as it was clear that they weren't together - he was MY boyfriend at the time!!!!0 -

thought i would give an update.
I had my informal visit today from the IS/DWP-compliance officer.
They started by asking about my sister and nephew, just ordinary questions.
Then asked to see her death certificate and nephew/my daughters birth certs - duly obliged.
then asked if i had any photo's etc, of sister and BIL, nephew together - duly obliged.
did i have any photo of myself and BIL together - i panicked the only one i had was at the zoo taken a few months before sister died, and we were all in that, but none of just us two.
asked where he worked, who for, then asked if i knew his annual salary - panic again, no i didnt have that sort of information.
more questions about his relationship with nephew - what did nephew call him ? apart from some un repeatable expletives sometimes, just his name or a nickname he has for him, sometimes nephew calls him pops.
what would sleeping/living arrangements be - duly explained
after about an hour, thanked me for my information and said if the arrangement should become permanant i should notify them of it, other than that they see no reason to proceed with any investigation and my benefit will remain intact. and i should inform council tax when he moves in.
does this mean it will be ok to move in then - i hope so. back door wants painting before winter sets in

no they never offered anything to me, but they did write everything down in thier file, but i suppose thats no evidence for me, i dont want to ring and ask in case i upset the apple cart.
