First off its 'Rights" not 'Wrights'.

Secondly, animals are covered with the same consumer rights under the sale of goods act 1969 as any other goods. This allows you to reject the goods for a full refund or a replacement withinn a reasonable period (which this is IMO). After this you have a right to a remedy which in this case would also be replace or refund as you cant repair a fish!

However you may face difficulty if the shop turns around and says its due to improper care etc. But under the SOGA, it is their responsibility to prove this if they want to reject a claim.

What sort of value are we talking here? I remember buying goldfish for 99p, one lived to 15 years old.

    Ian, Matthew, Bob, Clarissa Dickson...

Anyway, livestock does fall under the Sales of Goods Act, so you should have redress under that... assuming that you cared for the fish in the correct manner that is.

    the fish were £9,

Well follow my first post then. If they were £1 or something it wouldnt be worthwhile.

  • Were the fish coldwater or tropical?

Were you putting them into an established tank?

Are there any other fish in the tank?

My husband has several tanks. We bought some fish from a supplier and they died within 3 days. It was a well established tank with many other fish in it. We had to provide a sample of the water that was screened and the tank was deemed disease free so the fish were obviously poorly when we bought them and we got a refund.

  • the fish are tropical, the tank has been running about 3 months, there are other fish in there and they are fine, we have checked the water and it is mostly fine but the nitrate is about 30 on the chart, the man in the shop said that was ok weasked advice on how to reduce it.

Depends how and why they died!
First of all, what type of fish were they?
What size tank are you putting them in, is it heated, what sort of filter do you have?
What are your water parameters e.g. levels of Ammonia, Nitrite, Nitrate and pH.
How long has the tank been running? What's your water change schedule?
How often do you feed them? How much? What other fish are in the tank?

All these and more are what your aquarium shop is going to be asking you.

Sorry I was typing while you were replying!
"Tropical" is a massive range, what fish specifically.

Reducing your nitrate is the easiest of them all! Water changes!
