I had my shoddy medical last week with the atos morons and I failed it (as per usual) it says on the decision letter that i can claim JSA whilst I appeal, i just rang them to enquire about if its ok to claim whilst i appeal and the lady on the phone said that whilst i am appealing a ESA claim i am entitled to claim income support.
is that right?

Income Support is intended for people who cannot normally work (or who work fewer than 16 hours a week), and who are on a low income. For example, if you:- Are incapable of work due to illness or disability.

Who can get Income Support
It's for people who all the following apply to:- are between age 16 and the age they can get Pension Credit
- have a low income
- work less than 16 hours a week
- aren't in full-time study (but there are some exceptions)
- don't get Jobseeker's Allowance or Employment and Support Allowance
- don't have savings above £16,000
- live in Great Britain
- a lone parent
- on parental or paternity leave
- a carer
- a refugee learning English who arrived less than a year ago

had the medical report today in the post and to say im disgusted is an understatement, its chock full of lies about things that were not even discussed at the medical and the things that were are twisted in their favour.
i had 9 points from the needed 15.

Appealing against a disfavourable ESA decision is not, on its own, grounds to claim income support. You may, however, receive the assessment rate of ESA pending the appeal0
