Pixmania - owned by Currys - AVOID

I cant believe that I fell for it - Im usually really particular about who I buy from but this one fell thru the net and Im regretting it already.

My mother recently had lots of problems with Currys (part of the DSG Group) and I couldnt get customer services to see sense and we sat back and were shafted.

I made a resolution NEVER to buy from a DSG company again.

So, when I was looking to buy a washer/dryer earlier this week I came across Pixmania.

Their website stated how you could cancel your order online if you paid by credit/debit card and the whole thing appeared great.

So, I ordered a washer/dryer. When i had paid, I was simply told that I would be allocated a delivery slot within the next 2/3 days. No choice or anything.

Around an hour after placing my order, I received a phone call from Italy asking if I had placed the order. The person wanted loads of personal info from me and I refused to hand it over as I didnt have a clue who they were.

I got the computer out and took another look at Pixmania - only to find they are in fact a DSG company.

So, I emailed them within 2 hours of the purchase and I went online to cancel - as per their terms and conditions - only to be faced with a message stating I couldnt cancel as the order had been validated.

A series of emails were exchanged where I stated I wished to cancel and that the goods should not be sent to me.

Two days later, they informed me that I should refuse the goods when they deliver them.

I immediately smelt a rat and asked them to confirm that the £29.99 delivery charge would be refunded - but was told that as I would be refusing the actual delivery it would not be refunded.

I explained that the goods hadnt even been put on the lorry yet and that I had cancelled the order within 2 hours - if they still wanted to deliver the machine that was up to them but I had cancelled it before the delivery even took place.

They are refusing to refund the £29.99 delivery charge.

I got out my original confirmation email which gave a number for delivery quiries - I rang it and found it didnt exist.

There is a website where you can check on the progress of a delivery - that returned a database error every time I checked it.

I also have to wait for the machine to be returned to them, for it to be checked and then for a refund to take place.

Since researching Pixmania further, I have come across many issues of people waiting a very long time to get a refund.

What can I do?

These people really are scum and should not be allowed to advertise T&Cs which they refuse to honour.

I intend to complain to Trading Standards and - even for £30 - I feel a Small Claims Court action is likely as these people cannot be allowed to walk all over consumers.

PLEASE stay away from Pixmania and all DSG companies (Currys etc)

    Please note that Comet is not 'a DSG company'.

    Also note that Pixmania is based in France. I think you will need to quote the French version of the Distance Selling Regulations to them.
    There are plenty of references to Articles of the French Consumer Code in their Terms and Conditions.

    If it were a UK company, they would need to refund all monies paid, including price of delivery of the thing to you. Their T&Cs may help to decide whether you need to pay for the return of the thing to them.

    Pixmania are a special company. Combine the Gallic Who-gives-a-fcuk with legendary DSG service and it's a recipe for disaster. I have stated time and time again that I would rather chop my nadgers off before ordering from Pix.

    As to whether Pix are a UK company, well they have a physical UK store presence in Central London.

    Thanks for the tip on editing.

    I managed to get the [EMAIL="currys_uk@pixmania"]currys_uk@pixmania[/EMAIL] email address from them and they have written to confirm a full refund will be issued.

    However, they've been saying that all along but then state the delivery charge wont be refunded.

    Ive written AGAIN to ask that this be clarified.

    Will update when I get the money back.

    I'm also having probs with pixmania!!
    Bought a digital camera 2 years ago - no probs.
    Bought a Digital SLR in May this year and the charger failed after 3 months.
    Their customer "services" quoted their Ts&Cs to claim they were not responsible. I quoted Sale of Goods Act. They then came back quoting French law. I contacted Which? Legal Support and then pointed out to Pixmania that the contract was made in England and paid in ££ and therefore English Law applied ( Which? also told me that Pixmania was a subsidiary of Dixons)
    Their email then said they were passing my claim for a replacement to "another department" After 10 days I chased them and we went round the loop again! All the same evasions until I asked them to refer the issue to their legal department. Nothing heard for 10 days, so I chased again and guess what! It was like Groundhog Day, around the same houses again.
    I have had to replace the charger myself and this has now become a matter of principle.
    I feel letters to Which?, Trading Standards and Watchdog coming on.

    Just beware of these guys as they don't appear to want to adhere to English Law.

    Dixons stores group is the parent company, but this has no relevance. Pixmania as an entity is based in France.

    Which? have told you a load of BS. The currency paid means nothing, i could pay you in monopoly money, doent mean i live on Mayfair.... Where the contract is set is a very grey area, but seeing as were both in the EU, its far easier to just use their law. How on earth do you expect to enforce English Law in a French court?

    Why not read their T&C's? It mentions the relevant French law which you could then read for yourself and use to get things moving. If needs be, bring an action in the French courts;)
    Back by no demand whatsoever.

    There are plenty of internet threads warning of the legendary Pixamania service. As sh1te customer service is a Pixmania given and as they rely on French law you may as well treat them as a scamming Nigerian company in your efforts to gain redress. At least with a Nigerian you might get some sympathy. :D
