    I disagree only insofar as the element of theft that is likely to be absent. By selling a removed vehicle it is implicit that this will necessarily permanently deprive the owner of it. The act of selling the vehicle means that the clamper must assume the rights of ownership and in so doing must perforce have the intent. However, given that he is likely to argue that by selling the vehicle he is recouping his losses or expense, he would almost certainly lack the necessary dishonesty.

    Conversion very much remains an option.

    But again how can you sell something that is not yours to sell ? Wouldn't you need a court order to do that ? What about finance on the vehicle ?

    I am truly glad that these thieving scumbags are shortly going out of business, what a great christmas present ;)
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Unfortunately, it looks like the banning of clamping will be delayed for several months at best, and at worst may be scrapped altogether. :(

    It doesn't mean that clamping is not being banned as planned, I got an email from the home office a couple of weeks ago to say that clamping is being banned, so it should be illegal shortly in the new year

    I don't think jkdd77's conclusion is entirely unreasonable. What is clear is that Libservative/Coneral Clegg seems to have bitten off far more than he can chew and, to some degree, the Freedom Bill seems to have become synonymous with business deregulation rather than the vaunted - and published - intention of removing overbearing regulation of the population as a whole. Read the Freedom Bill here

    What on earth made this twit imagine that just because he thought he had come up with the idea that public weren't ready with a whole swathe of suggestions? He should have prepared himself for this. In my eyes its just another illustration of just how out of touch with the public our so-called politicians are.[/rant]

    I've received a reply from the Home Office stating:

    "Ministers plan to include the ban in the Freedom Bill which will be introduced before February 2011. The Bill is unlikely to receive Royal Assent before autumn 2011. It will then be necessary to introduce secondary legislation to bring the ban into force."

    LBS and other rogue clamping firms will be celebrating tonight. :mad:
