    The PWC has to request a variation to have the housing costs taken into account - it cannot happen otherwise - if it ever has then it should not have. A cat A IMA is 1.5 times the maintenance needed, a cat b is where there is no protected income given, so the NRP pays the full amount based on their own assessable income - no account given for whether the household income could accommodate it.

    Kelloggs so can I ask for a variation then? If so, I will phone back this silly woman who is dealing with my case and tell her I just want to be armed with the correct info 1st. Thanks

    Yes, you can apply for a variation and they should send you the form and ask the NRP to provide the partner's details. If they refuse, then the CSA can then assume anything from 1-100% of housing costs be apportioned to the NRPP.
  • Thankyou so much Kelloggs this woman who is from the escalated clerical complaints team (Falkirk) was adamant i could not do a variation, would they backdate it? as I asked for a variation at the start of the assessment 3 times but they never sent me the forms. Thanks

  • Have an update have just got off the phone with the CSA im told rules have changed they have sent my ex a letter asking for the NRPP income details if they are not provided within 10 days they assume 100% of the housing costs are paid by the NRPP, and that they no longer do variations on the grounds of aportioning housing costs if the details are NOT provided. This is what I have been told so please people dont jump on me for this info. Thanks

    The reason being, is that they have already stopped the housing costs - ask them to quote the legislation that allows them to do this, as it must be very new.

    Hi Kelloggs, they havent stopped his housing costs hes already been given the full amount on the current assessment the (IMAB) but they have halved the allowances (child), they said after this letter they have sent out if he doesnt give the info required then he gets nil for his housing. I did ask about a variation as you advised and this was what I was told and she said it was a recent change to the rules but I will ask again about the legislation so everyone on here can be updated properly too. Im 99% sure she said this rule came into effect 18 months ago but will confirm.
