Chinese Seller

In a nutshell:

Bought a new phone in August for £40.
Didn't arrive, seller has good feedback every day for similar items
Good comms said they would send another
Nothing has arrived
Comms now ignored
Can't even feedback, have they blocked me on the bought item?

Anything I can do? I started a Paypal dispute which expired when the 45 day mark was breached.
i feel like buying the dude's entire stock and telling him where to go in feedback but I'm sure this would backfire on me.

Help.

Nothing you can do. You have 60 days to leave feedback. Why did the paypal claim "expire"?

45 day rule presumably, so Paypal can wash their hands of it. I'm not an expert to be honest.

The fact there is nothing that I can do pretty much sucks ,except for being daft enough to buy in the 1st place.

So I should create a fake ID and home address and hijack his sales right? :j

Can a seller withdraw the right to feedback within 60 days of sale when he knows the buyer is not best pleased?

The seller hasn't withdrawn anything?

Ebay allow feedback to be left by both parties for up to 60 days. A paypal claim can be started for 45 days .

Unfortunately you were either not aware of chose not to use the system within those time frames.

You have 45 days to start a claim, so as long as you started a claim within that period you will win an item not received case.

Are you sure they are still registered on ebay?

Did you pay for the phone via a credit card?

If so ask if you can claim anything back this way.

Paypal states : -

This dispute closed because it was open for more than 45 days after the transaction date or did not meet other criteria for opening a dispute.

Useless or what? You could legally drive a bus through that statement. Does anyone know why Paypal closed my dispute?

I did and the case is now closed on Paypal website. "This dispute closed because it was open for more than 45 days after the transaction date or did not meet other criteria for opening a dispute." I wish you were correct but it seems you are not. If >45 days had elapsed, then it would not have let me start the dispute, but it did. And now it's closed.

For 45 days? Within 45 days? After eg. 30 days but when 45 days elapse then I'm screwed?

It's totally wide open, whatever causes Paypal the least work..

OP, you have 45 days after you paid to open a claim, after this you cannot raise a claim. However if you open a claim on day 40, it'll stay open till it's resolved...not end on day 45.

If something different happened, contact paypal and ask for an explanation...
