Tesco Car Insurance - Small claims court or Ombudsman?

Tesco have admitted that they have listened to the original call and that I did in fact ask for a quote on a Mini One Diesel and that the lady who gave me the quote repeated the details back to me as a Mini One Diesel , they have admitted that it was their error and not mine. She had put into their computer system a Mini One Petrol.
I had a letter from them yesterday saying that they know that they are out of time on their complaints policy but that they are still investigating the matter and hope that I will allow them further time to complete their investigations but that I can now take the matter to the FOS if I wish.
From what you are all saying , this wouldnt be worth the effort?

I would. As someone else pointed out, the quote would have been valid for a short period (up to 30 days), so by not honouring the quote, you have had to seek cover elsewhere.
If you go to the FOS, the Tesco underwriters UKI will be charged a case fee of £500 and it will cost you nothing. Probably best to just pick up the phone to the FOS and give them the complaint info that way. The FOS w!ll then contact UKI with the info and you might get a resolution from UKI, before the FOS consider the matter further.

Thanks -Thats what I dont understand - why would they invite me to go to the FOS and thereby incur themselves a £500 case fee - why not just say either they dont think that they have a case to answer at all and to go away or make me an offer of £200 to go away as someone mentioned that they were doing earlier ?0 -
Put it this way.
UKI lost the contract with Tesco. They are running down the Tesco portfolio between Oct 10 to Oct 11 with renewals gradually transfering to Ageas (nee' Fortis).
UKI allegedly have a backlog of over 10,000 complaints, according to a post to another site.
UKI part of Royal Bank of Scotland Insurance is planning on major restructuring ( job losses) over the next few years.
So probably the people dealing with the complaints have a massive task on their hands and are not motivated or bothered enough to try to stop any complaint you have going to the FOS. They dont have a choice. They have to offer you the FOS option if they cant resolve it within the agreed timescale.I am an Independent Financial Adviser (IFA). Think everyone on here is giving u false information!! Clearly they have no idea of the implications of giving customers the wrong information is! You have a great case and need to speak to the insurance oms!! Not the small claims court!!! Companys poo there pants when the oms are involved as it costs them 750 pounds per correspondence!! Stick with it and you will get compensation and the premium for what you were quoted!!!

Most contributors to the thread have advised the OP to go to the FOS, which hopefully they have done by now. Or even better if Tesco sorted out the complaint, to save the OP having a long wait for the FOS to decide on their case.The comments I post are personal opinion. Read it through again and the responses seem fine. As is usual with most threads, the information develops over the thread and not just supplied in the first 1 or 2 posts and the responses adapt to that.You have a great case and need to speak to the insurance oms!
