XBox 360 Sale of Goods Act

Hi All,

In Dec 2007 I purchased an XBox 360 for my son. It now displays an E73 error code which makes the XBox unuseable. This error is a known problem and can be temporarily fixed, however the fix will only work for a few months. Therefore, I believe that the the XBox is not 'fit for purpose' and one would reasonably expect it to work for longer period than I have experienced.

Do I have a cast iron case whereby I am protected by the Sale of Goods Act and can demand a free repair of replacement? The item was purchased through Amazon.

    Not really. The warranty for the xbox is one year. 3 years for the red ring of death. You have had it for 3 years now, your only option is to pay for it to be repaired, or to buy another one. If you try and send it back to Amazon they will say it is out of warranty and ask you to send it to Microsoft, who will say it is out of warranty and ask yo to pay for repair.

    There is no cheap way to get out of this I am afraid.

    be thankful it lasted this long !!! i was on my 4th white Xbox in 3 years when i decided to go for a elite this year .

    you can probably get a Elite from Game for about £120 (Like i did) if you already have a hard drive and controllers to plug into a base model . Elites have much better reliability and you can get a good warranty from Game that covers everything not just RROD

    no chance with sale of good acts IMO , hand in pocket time me thinks .

    Sadly, it's not what you believe that's important, it's whether a judge would believe the same thing. To be honest, I think you'll struggle somewhat...3 years is a long time in the world of video games. I bought a new 360 when mine failed after around 2.5 years - I'd had a lot of use out of the thing, so having to replace it wasn't the end of the world...

    I went through four as well. The last one which was a replacement from MS lasted 9 months - just long enough to take me over the 3 year limit. Replaced it with a new S series one. Far far better than the original or the elite. Runs nearly silent and is far cooler.

    Really you would need trading standards advice and it would be worth pointing out that its a known problem .

    Broadly it seems to say that if the goods are less than 6 months old then the seller has to prove that the goods were not faulty when sold to you. After that the onus switches to you - you have to prove that the fault isn't due to accidental damage or simple wear and tear.

    I sympathise (RIP beloved first PS3 :( ) but I don't think you have much chance of success.

    As it was purchased in December 2007 it is still within the 3 years for RROD is it not? Get it repaired now and make the most of the time that the fix lasts for before you have to purchase a new one.

    I'm gobsmacked that posters here think that 2 years is acceptable for an electrical item to last. Shoddy.

    Had the same problem with our PS3, it broke after 18 months. Sony offered to ''fix'' it for £120, so i said thanks but no thanks!

    Wrote an email to Gamestation who i had bought it from , stating the 'I would expect an electrical item that cost me £250 to last longer then this etc etc' (found a templete on the net for it, sorry cant remember where just try googling it) and attached the reciept as i had ordered it online.

    To my surprize gamestation organised someone to come pick it up and sent it to sony for repair free of charge!
    My partner then decided to buy a new slim one and we sold the repaired one for £120 to my brother !

    Have to say i was surprized and shocked that they did that, but good on them for their customer service much better then the bigger companies.

    Get real. Anyway, this is about electronic items not electrical. There is a difference.
