What's to say that you'll be getting a chav's ruined one? Yours is faulty and if it gets reconditioned, would you appreciate someone branding you a chav and claiming you've ruined your console when they're due to receive it?

Because it's happened to me before. I sent an item away for "repair" and what I got back was a damaged, scratched and ugly replacement. They never even attempted a repair on my good cosmetically perfect item they just sent me something that looked like it'd been used for football practice.

I take care of my items. It's the reason I buy new and not second hand, so that I know it's clean and tidy when I open the box. If I'd wanted a scared and filthy PS3 I'd have bought one off eBay for half the RRP!

I don't want a replacement, I want mine repaired. Sony can't gaurentee that I'll get my console back so I'm dubious of sending it to them. This is why I was asking where I stood with the right to take it back to Argos.

If they do send you a cosmetically damaged replacement, then just reject it. FWIW, Microsoft do the same. One of my son's friends had an Xbox that failed, MS sent him a replacement. Some 3 months later, his dad went to the US on a business trip, and decided to buy himself an Xbox from an official MS re-seller. When he got back to the UK, his son looked at it and said " that's my old Xbox. Look, I etched our postcode into the bottom of it when I first had it."
    Never Knowingly Understood.

maybe the 1 you sent back wasnt worth repairing, with the xbox 360 you get sent a reconditioned 1(i guess if any are in stock)

Obviously Sony are allowed to do it, but I do feel it's very bad practice. I have a PS3 which I mainly bought as a Blue Ray player so it doesn't get a lot of use.

If it had gone wrong during it's guarantee I would have been very annoyed to have been given a second hand replacement. It could have been on permanently and it's hard drive might have been near the end of it's life. Worst still it may have come from a home where people smoke.

I'm a non smoker like the majority of people in this country and I do a lot of computer repairs. When you repair one that comes from a smoker it makes the whole house smell and the insides are covered in sticky tar.

I'm with you Zandoni. I hate getting stuff off eBay only for it to turn up stinking of smoke, it's revolting. A smoke-smelling PS3 hadn't occured to me, but now you mention it it's one more thing putting me off sending it away for repair. And thanks for saying that, I was starting to think I was the only one who values their personal belongings.

I think I'll send the controller to them see if that solves the problem but I'm extremely reluctant to send the whole console. If it fails in the future I'll play the Sale of Goods Act card, but I'm not taking the chance of getting a worse console back whilst this one's problems are only intermitant.

If you forget the controller for a moment, have you done any research about the sound and video probs you have.

There's lots of help on the net about this sort of thing, it may be that your TV is not setup correctly.

Even trying another HDMI port on the tv if you have more than one.

I haven't as yet, but I will do.

I'm fairly sure everything's connected properly and I've done all the setting on the PS3 and the TV (the TV's Sony also) so I'm not sure what else I can do. But I'll have a Google to see what comes up. :)
