Where do I stand on a faulty PS3?

I'm going to try and keep this short, hope someone can help?

I bought a PS3 from Argos early December 2009 and I've recently been having a few problems with it. The biggest problem is that the controller keeps disconnecting and, in order to get it to reconnect I have to go through a whole rigmarole of connecting it via the USB cable and resetting the console. The other problem is that, on occassion, I'll loose all sound and vision whist playing a game or watching a video. It'll come back on, so I don't think it's switching off, but it's really annoying nonetheless.

I've contacted SCEE and they said I have to send the controller back and they'll test and, if they deam it to be faulty, they'll send me a new one. But I'm not really happy with that as I don't know how long they'll have it for and I don't have another controller I can use in the meantime. And it doesn't address the sound/vision glitches.

So my question is, as it's still within warrenty am I within my rights to take it back to Argos for repair or exchange and, if so, which should I ask for? I just want to be able to play games like I should be able to and not sat a foot and a half from the TV!

    as the problem is over 6 months old, it is up to you to prove that it has an inherent fault in the form of a report, which if you are sucessful then you would get the money back from Argos

    Well, as I said, the fault's quite recent and not more than 6 months old. I'd say it's three or four months.

    Not sure what you mean by a report; I'm not an electrical engineer so can't write a proper report on it. Any, "And it just turned off at 12.20pm" kind of stuff is surely just circumstantial and, therefore, pointless? I could take it to Argos and get them to test it I suppose, but as it's intermittant I could be there for a while!

    My controller went for the PS3 a couple of weeks ago. Contacted Sony via Phone and they said for me to send it to them, If there is nothing wrong they will send it back but if there is something wrong they would send me a new one.

    HTH I cannot find the tel number but try googling it.

    I sent it off recorded delivery on a tue and i had a replacement on a thursday.

    The age of the fault has nothing to do with it. The age of the goods does. Whilst anmarj was correct, they perhaps should have stated that the retailer is within their rights to request an engineers report (which you would pay for) proving the fault t be inherent to get anywhere.

    Now thats not to say that you wont get a refund or exchange without one!

    Why not go to Argos and ask?

    If they dont refund than you can start spouting off your consumer rights under the Sale of Goods act 1979 whereby goods should be of satisfactory quality and free from defects for up to 6 years.

    Consumer direct has some decent info on the act, and google will unearth the nitty gritty of the act if you want to be fully brushed up. But like i said, dont be surprised if they do ask for a report!.
    Back by no demand whatsoever.

    You don't need to get involved with reports etc with companies like Argos who offer a one year guarantee.

    Of course you can take it back to Argos as it's still under guarantee and they will probably send it off for repair.

    It will be much quicker if you go direct to Sony who will probably give you a like new reconditioned unit. Which is not ideal but it's the best you will get as it's nearly a year old.

    Well, I poped into Argos when I was in town yesterday and she told me I had to contact Sony. Tried the Sale of Goods Act line but she just shrugged and said, "Sony have told us you have to contact them" So it looks like I either have to put up with the console's black screen or send it to Sony so they can send me some chav's ruined one in place of my mint one. What's the point in having acts of law if no-one abides by them?

    Argos will probably just send it off to Sony anyway for repair or give you a reconditioned one , just because its a recon does not mean it will be battered it should be like new.

    Yes you contract is with Argos yes you could argue with Argos, but sometimes its easier going to the manufacturer as that's all Argos will do on your behalf.

    What's to say that you'll be getting a chav's ruined one? Yours is faulty and if it gets reconditioned, would you appreciate someone branding you a chav and claiming you've ruined your console when they're due to receive it?
