Cancelling mobile contract....

hi, im on a business contract with orange, approx 6 months into an 18month contract. i received the contract to sign and return but i asked them to make a change, i never received a new contract but received the phone and started using it. i havent had many problems but recently the network coverage in my area for orange has become shocking, i rely heavily on my phone for work and i often go 5 - 6 hours a day without being able to make or receive calls. Can i cancel my contract without paying huge cancellation costs? as they dont have a signed contract with me....

is there anyone out there who has a contract without a signed agreement? am i able to cancel at all?

thanks in advance

Why not call them and see?
IIRC there will be implied terms from your phone usage though..

I complained about coverage to Three network as it died to nearly zero signal strength on 5 handsets. They issued pac codes after 4 weeks of trying to rectify the problem.

Its the same with all networks. You MUST report the problem to their tech support/faults and await their rely, then you can be issued with an early termination with no fee. As for the non-signed contract, its like dd debit setup over the phone... your signature is worthless as its all automated. Most of the time even when purchasing a deal on the internet, a contract is hardly ever signed. I would report the problem then await their response. Stay calm and hopefully you`ll get the result your looking for. Make sure you keep a log of events.

I just left THREE last week. I was on £20/month for 1200min xnet, unlimited 3 to 3, unlimited landlines, unlimited texts and 1gb internet. I have no sihnal in my area therefore I was allowed a pac code even though 16 months remaining on my 18 month contract. Signal was great until August 2010 then it just died in my area.
BTW I had the HTC Hero in white.

I was able to use my phone outside my work building and outside my house. Tech support knew about this and they issued a pac for each handset no problems.

  • thanks guys

i will give them a call to see what they say - i wanted an idea as to how to approach them and ive got that now from the replies.

if they can fix my network coverage problem somehow, then happy days. if not ive got to try and weasel out of the contract!

It make absolutely no difference if you've signed or not. You have an enforceable binding verbal contract with them that is just as valid as a written one. You are entitled to compensation for loss of service, but it does not invalidate your contract-especially as you've used it for 6m.

Yes, I think this is the key point. You would have a very hard time convincing a court that you didn't agree/accept the contract having used the device for this amount of time.
