Right, firstly it is not wrong, the law and DPA are there for a reason.

Now I offer you some advice, if you are as concerned as you sound regards this matter I would recommend you contact your local Police force and make them aware of when he is driving/where from/ his name and what you believe is true, i.e he is disq, then leave it in there hands, then IF and only IF anything should happen, at least you tried your best.

Or ask your friend to ask to see the licence again:D

If the person concerned asks for a reason I am sure someone can think of something suitable;)

(may even be better than making unfounded allegations to the police and wasting their time)

    Thanks for the helpful responses

Why am I asking? To support a friend who doesn't have the Internet so could not ask a helpful forum as I can. I'm a nice friend who is concerned she could end up in trouble.

The person driving the car has been asked but is a little intimidating
The person has a motor trader insurance policy and has driven the car as part of the service they provide to/from valeting etc so no requirement to inform their own insurer

My own insurer asked for a copy of my licence the first year but when subsequent renewals took place they did not ask

Anyway thanks, looks like there is no legal way of ensuring anyone you allow to drive your car including a motor trader has a valid licence ... Hmm

You say the person borrowing the car is a "little intimidating", this would put me off right away. If I was doing a favour and someone started to try to call the shots, then they would be sent on their way with a flea in their ear.
You friend has to be more assertive in situations like this. Imagine if the "intimidating" person went on to use the car in a crime.
I would suspect that anyone trying to "borrow" a car from someone else, is doing so for a reason. When you are driving along in a vehicle which is taxed, MOTd and insured the police can tell, and will not bother you.
If Mr/Ms Intimidator cannot get insurance for some reason (licence surrendered maybe), then they cannot legally buy a car and run it.
If you get fully involved in this, then make sure you can look after yourself.

If your friend is worried then the simple solution is to do what companies do before you are allowed to claim mileage. Ask to see the licence (both parts) and then take a photocopy. If at a later date it is found the person had held onto their licence illegally she would be covered.

FYI, companies from whom you are claiming mileage are also required to check you have insurance (correct class) and MOT. If they do not and you dont and you have an accident while working they can find themselves up to their neck in sh*t.

OP, hope you have managed to sort it out.

I personally think you need to either brave face and ask, and if the answer you get is Yes I have one and I'm not disq, then you need to accept that - or contact your local Police and take advice from them!

I'd go down the route of the insurers have been in touch and have asked the car's owner to fax a copy of the driver's license...

if he provided a license once, then he should do it again no problem...

though if he gets narky / annoyed with the request and doesn't provide the license i'd say no to letting him borrow the car next time he wants it.

And informed the insurers or what? That the guy may not have a valid license? when he may?

No, they're assuming she's told the insurers that someone else is driving her car.

Or ask for supporting evidence of that.

No need to accept it at all.
  • I would have to ask them directly and tell them the reason why I am asking ie someone has told me your license has been revoked, if the ops friend carries on letting the person use the car and they have a crash then it "could" cause allsorts of legal issues for the friend which is not fair considering they are basically being mislead.

Just ask the question and see what answer they get back it is about the only "responsible" thing they can do, dont forget if this person is un-licensed then it also invalidates any insurance...........................................
