Fermi is it the same for Scotland?

Yes it is the same in Scotland as the DWP is controlled centrally.

There are a few slight differences for Scotland, but as far as DWP debts go, essentially the same.

    Overpayment of social security benefits

The Department for Work and Pensions (DWP) has six years to take action through the courts to recover benefit overpayments. The time starts running from the date of the decision that the overpayment was recoverable. However, if more than six years have gone by, it may still be possible to recover the overpayment from another benefit you receive as the DWP do not have to go through the courts to do this.

The usual time limit of five years applies to overpayments of Housing Benefit and Council Tax Benefit.

Attempting to collect a statute barred debt isn't illegal.

But the OFT has this to say about collection of such debts by debt collectors and other consumer credit license holders.

Thank you very much for that explanation Fermi. :D

For all the hassle you could be put through in the next few months/years. Wouldn't it be easier just to pay the £68-00?

Time to bow out of this one I think however Good luck whatever the OP decides, but you may find it being deducted from any benefit you claim in the future, inc retirement pension. Without any warning as well (oh you get a statuatory letter) and don't say it won't happen because i've seen it done on numerous occasions.

    Computer sez yes.
