The ability of the seller to re-sell the item does not make the item exempt from the DSRs. The only exemptions are specific to a few categories and are clearly listed in the guidelines. The memorable ones are personalised items (where the item has been made to a specific customer's specifications) and unsealed media (on the grounds that the buyer may well have copied the CD or DVD and be returning the original, or have used a software key and no longer need the discs; that sounds like successful lobbying by the media industry to me). Hygiene is also no basis for refusing a return either.
So the buyer was actually within their rights to a c-o-m refund.
