Yes, probably. s2,3 and 11 of the Fraud Act 2006 are relevant. There could be an offence at the time of application and time of use.
BUT, the criminal burden of proof involved in showing fraud (a number of steps needed) is tough and even then, the police/CPS have to decide to take up the case.0 -
