Cancel a contract within 7 days??

Hello folks,
I have recently ordered an HTC Desire through the dreaded mobile.co.uk (I didn't know they were dreaded when I ordered it!) I ordered a contract that was 300mins, 300texts, unlimited data, £15 per month for 24 months.
The contract they have put me on in 100mins, unlimited texts an no data.
I have e-mailed mobiles.co.uk but to no avail (address no longer in use and its the web form on their website) can't get hold of them on the phone - its just cuts out or is closed when it shouldn't be. T-mobile can do nothing. My question is: What would happen if I cancelled my contract directly with T-mobile and stopped the direct debits? I am still within my 7 day cooling off period but cannot get hold on mobiles.co.uk....Can I do that??

Hi, I think you are going to have to sort it out with the retailer. I doubt that T-mobile would cancel the contract and if you stop the direct debits you will ruin your credit file and make it harder to get credit. If you can eventually contact the retailer you should be able to either sort things out or even cancel ( as long as you haven't opened the box and put the sim card in.) If you have , you are probably stuck with it.0

You cancellation will need to be done with mobiles.co.uk.
Mobiles.co.uk are a third party internet seller who sold you the contract on behalf of TMobile.
You would most likely have some information on returns and the phone will need to go back the same way as it came.0 -
Hi guys, thanks for this. But even though I have opned the phone and put the SIM card in, doesn't the 7 day cooling off period related to distance seeling still apply?0

I don't think so but you've got nothing to lose by trying , just don't cancel the direct debit.0

Sorry to hear that you are having problems. From the T&Cs that I have read with other providers, they'd like a cancellation request in writing. To be safe, if you want to cancel, it may be a good idea to send a letter to them via recorded delivery with your intention to cancel noting the reason. If you have any emails that confirms the contract you were expecting to receive I'd attach a printout of this.0

First off you have been missold the contract so the 7 days doesn't realy matter in this case ....however it may make it easier to use DSR's to cancel rather than argue about it.
You have 7 working days to advise them you wish to cancel which starts the day after you receive the phone.
If the email del system has now stopped you need to advise them by post asap and make sure you get it signed for ///as a stand by email CPW with your intentions in the morning so you have a fallback and explain you can not make contact with their company.
Make sure that you copy in T Mobile with whats going on pref by sending copies of your cancelation and later your post receipt etc so that they are aware of the situation.
Do not cancel the DD as this may affect your credit ratingIt's not just about the money0 -

Funny how in a world of electronic media, putting things on paper feels strangly satisfying. I might send several, it might up my chances of someone reading it!

Whilst they might be aware they will need confirmation of the time the time the contract was ended with the 3rd party should you receive any further bills or charges from them, the easiest way is to be able to direct them to hard copy facts.Funny how in a world of electronic media, putting things on paper feels strangly satisfying.
